It was expected: home sales would drop following the April end of the Homebuyer Tax Credit program. What wasn’t expected, and what has the industry reeling, is the depth of the drop-off. Pending home sales –meaning home sales that are under contract but are not yet closed- fell off 30% in May from its April mark. This drop, to put it in perspective, is the largest single month drop ever recorded, and to make it even more significant, was a 15.9% decrease for the same month a year earlier.

Some would call this drop a falling off a cliff. A free-fall of painful proportions. And though it wasn’t fully unexpected, it still stings.

What it means

Does this level of drop-off mean anything to long-term health or growth of the housing industry? The debate can now be opened up. Many factors came to pass in April, including the Federal government no longer buying up troubled assets, the homebuyer credit coming to an end, and interest rates beginning their rise up from historically low levels.

Another factor that is contributing to the drop-off is the slow economic recovery in this country. Millions of people remain out of work and millions more have been laid off in recent months. It was the perfect compilation of factors that would –each, individually- have led to a decrease in the number of pending home sales in May, regardless of other factors. Yet taken together as a whole, all aggregate factors combined to offer the struggling real estate market the worst single month drop in its history. All this according to the National Association of Realtors (NAR).

How to handle the news

It may seem bleak for many of the nation’s realtors, one thing that can be taken away from this abysmal report is that perhaps the worst is now behind us. News has surfaced that President Obama is considering extending the homebuyer tax credit through September, the government is indicating that growth is steady, which means employers will soon be hiring once again, and the Wall Street Reform bill that is expected to pass and be signed into law can open up lending within many of the nation’s leading financial institutions.

As realtors or mortgage brokers or lenders, May’s numbers are certainly eye-opening, even depressing, but it’s up to each of us to look beyond the number, beyond the factors that led to that drop-off, and see the signs of recovery that surround us everyday.

Is the worst truly behind us?

It is certainly a challenge to remain positive and optimistic as the weeks roll into months and the months stretch out into years, but it is incumbent upon us to continue to think positively, to shrug off the bad, staggering news, and look for the silver linings, wherever they may be hiding. The alternative is to continue to be morose and downtrodden about the economic climate around us, and when that happens, it becomes exceedingly challenging to get other people, most importantly potential homebuyers, to feel positive about the future.

No one truly knows what lies around the next corner of this recession. Depending on whom you ask, you will receive a different answer. And it always seems to be politically motivated. Don’t look to Washington for the answers; look to your own community. Emphasize the positives that have happened over the past year, or the past month, or the past week.

The only way to turn tragically bad news, such as the May pending home sales report, into positive indications is on a local, community-based level and within every community, there are beacons of light shining everywhere; you just need to look harder.

I bought a jeep in the spring and was trailering it to go wheeling, but now i sold my car and my truck is a gas hog so i was looking to get my jeep on the road. when i bought it, it was said to be a salvaged vehicle and the title was lost at the salvage yard, so i got a bill of sale. if anyone knows how to possibly get a title form a bill of sale or if it is even possible. i dont know if its any different other places but im in pennsylvania.

There is a process to do this, your local Dept. of motor vehicles will give you the appropriate paeprwork to do this. It takes a bit of time, but it can be done. Each state is a bit different. In California, there is a rather large stack of forms to complete. It is done to make sure, no previous owner has claims on the vehicle, hope this helps. Fyi. it is not a slam dunk easy thing to do!

Short Sale Foreclosure Options for the Underwater Mortgage Holder

Given the housing market, we’re not surprised if you’ve just found out you’ve got an underwater mortgage. Right now 24% of all homeowners are in the same boat as you, with one in ten of them owing 25% more than their homes are worth!

So what are your options when you’re faced with an underwater mortgage? Let’s take a look:

Staying in the house and paying off the mortgage. This could be a sound business decision under a limited set of circumstances: if the value of your house is only, say, 5% to 10% less than what you owe on your mortgage, or if you’re close to having your mortgage paid off. And, of course, if you still have a job or business that lets you make the payments.

But don’t count on property values going up a substantial amount any time soon.

Right now, banks have a record number of foreclosed properties—1.1 million—and that number isn’t going to go down any time soon. It may well continue rising, and that means even more downward pressure on property values!

Loan modification. Don’t get your hopes up about this one—less than 3% of homeowners qualify for a modification on their underwater mortgages. And two of the available modifications will lead you to paying even more on that mortgage!

Deed in lieu. In this case, you hand the keys to the bank. You move out immediately. Then the bank sells your house for pennies on the dollar and comes after you for the rest of the mortgage. This isn’t an option—it’s another trap!

Short sale. This is an option where you and your mortgage lender agree that the lender will accept being paid by a sale on your home that doesn’t actually fully pay off the mortgage—called a “short” payoff. At worst, negotiating for a short sale gives you time to live in your house rent-free. At best, you can walk away from your underwater mortgage without having to take such a big hit on your credit rating!

Foreclosure. Don’t be shocked—foreclosure is a legitimate option for dealing with your underwater mortgage! Think about it—do big businesses or banks themselves keep paying on an underwater mortgage when property values drop or when they’ve run into financial trouble? They do not. Go ahead and look it up.

And then be angry about how the financial services industry has sold everyone a bill of goods about how we should be playing by different rules than they play by when it comes to underwater mortgages!

Granted, Kristin and I aren’t saying that anyone should let their morals sink to the level of your average CEO. But on the other hand, what higher moral principle is there than looking out for and protecting your own family?

Now, there are side effects to foreclosure. Your credit will take a hit, and in some states, your lender may try to milk you for the difference between what it sells your house for and the full value of the mortgage. The big banks are just starting to get aggressive about this in the past few months.

I sold an old motercycle on ebay and the buyer is coming to get it tommorrow and he wants me to write a bill of sale. How do I go about doing this?

There is Life After a Short Sale or a Foreclosure

Selling or buying property or a vehicle can be confusing and stressful enough, without the added worry associated with not knowing your rights. Protect yourself with a professional Bill Of Sale.

As Realtors, we know that a lot of our clients don’t think that there’s any such thing as life after a short sale or a foreclosure. They assume that their credit will be trashed forever, that they’ll become social pariahs, that their foreheads will be forever branded with a great, big, red “L” for “Loser.”

OK, maybe not that last one. But you get the picture. Most of us have let ourselves be so brainwashed by the banks that we really believe that a short sale or a foreclosure makes us bad people who deserve to be punished!

Kristin and I can certainly relate to that feeling! But would it make you feel better to know that we’ve been through not just one, but multiple short sales orforeclosures in the past 3 years? That’s right—we believed the “experts,” too, and we did a lot of investing in real estate before the bubble burst. So, yes, we went through multiple foreclosures and short sales, which we initiated, to get ourselves out from under a mountain of bad paper.

That’s right. We short sold or foreclosed on all of our personal properties.  And what are our lives like after foreclosure?

We still live in our own home; however, now we’re renting it for a fraction of our monthly mortgage payment from the cash investor we sold it to in a short sale.

Our credit did take a hit, but we know how to recover from that quickly (and we can show you, too!). In the meantime, it’s really not hurting us to pay cash more often and to live well within our means—which we weren’t doing when we thought we were high-flying real-estate tycoons!

We still have our family and friends. No one who matters thinks of us as anything but savvy business people who foreclosed or short sold because we had to save ourselves. And, better yet, our immediate family is more rock-solid than ever!

No sign of that “L” shaped branding iron. We promise.

Of course, you need to be proactive before a foreclosure or a short sale, so you can make the best life afterwards.

First, make sure you keep paying all of your other bills on time. This will make you seem like less of a credit risk even with a foreclosure on your record. And really, consider the millions of other foreclosures taking place during this time period. Does anyone honestly think that the banks will be able to afford to turn us all away as the economy recovers?

If you’re going to need a new car in the next 5–7 years, buy it before your first unpaid mortgage payment if you can. This will save you hundreds, or even thousands, of dollars of interest that you would probably be socked with after your foreclosure.

As for the rest of the money you’ll be saving when you’re not making house payments? Save it up! Don’t leave your house before you have to—live there for free while you’re making plans for your next move. That’s money you’ll be able to invest in your future!

So you see, you can have a good, happy, stress free and financially sound life after a foreclosure or a short sale. And the best thing is that giving up your house is a good lesson to us that, maybe, we really don’t need all of that stuff and all of that house that we were so attached to. If we learn that, we really come out ahead!

Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. But the financial adviser is asking me for a Bill of Sale. To me the bill of sale (especially signed) would be fraudulent because it would not actually be sold until the transaction of money and pink-slip between my bro-in-law and me.

Am I over thinking this?

It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

I did that when I bought a car from my brother. I gave him $1000 and he wrote the bill of sale for $100.
I think as long as you don’t do anything stupid, you should be ok.
Not save that much? are you serious? depending on the local sales tax and the actual price of the car, this can be quite allot of money. If the actual price is $5000 and they mark the bill of sale as $1000, if the sales tax is 7%, that saves $280

We’re both Realtors, and while our training and connections certainly helped us, we’ve also seen more people than we can count get through short sales and come out the other end smiling.

Just like in boot camp, the first thing you need to work on is your mindset. When you’re facing an underwater mortgage and financial troubles, you have to stop thinking like a homeowner and start thinking like a business person.

What do we mean by that? Well, consider for a moment the way your mortgage lender looks at your house. Your house isn’t memories to your lender, and it doesn’t represent the feeling of accomplishment you had when you walked into your house, key in hand, for the first time.

To your mortgage lender, your house is just numbers and a description on a few pieces of paper.

And while it might be painful at first for you to look at it this way, in a short sale situation you have to look at your house the way the bank does.

My wife, Kristin, specializes in short sales now, and this is a struggle she sees people having all the time. But what’s worse—giving up the house or giving up your financial future?

Because if you’re having financial difficulties and you have an underwater mortgage, that’s the decision you’re faced with right now. If you wouldn’t be willing to risk your life to save your house, why risk your future to save it?

This mental toughness comes into play when you’re listing your home for short sale. Your home is only worth what someone else is willing to pay for it, and not a penny more. So be realistic about this. Follow your Realtor’s advice about the true value of your house. Getting out from under your underwater mortgage depends on it!

Of course, the other place your new mental toughness has to come into play is with your mortgage lender. You’re going to need to stay strong in the face of bank employees who still may not get the fact that ordinary people are now playing by the same rules that large institutions play by. When a mortgage is underwater and people can’t pay anymore, they’re walking away.

Just like large businesses do. This is a business decision, it’s not a moral one. You need to look out for yourself just as your mortgage lender looks out for their own best interests.

And just as you get in awesome shape when you’re going through a real boot camp, in short-sale boot camp, you’re going to have to get your financial house in order. Make sure you’re paying your other bills on time to protect your credit rating. And be sure to close any other accounts you have with your mortgage lender!

With the proper mindset, the proper preparation, and help from your Realtor, getting out from under your underwater mortgage through a short sale can be a relatively easy process. We can’t guarantee it will be a fast process, mind you—it can take up to a year to close a deal. There was a time, long before the Internet, when most people looked forward to getting mail. I mean real mail like letters from friends and relatives. Letters that were written personally, in ink, using a fountain pen and later the more convenient ball point.

The title acts as the bill of sale. So throw out your bill of sale.
If you filled out the back as the buyer already, then get a REG 256 Statement of facts and say “buyer never took possession of vehicle and filled out title in error” And sell the car with just your grandma as the seller. Now you need an additional paper for the new buyer to fill out. REG 101 Statment of Erasure or Error. Have the new buyer fill this out AND give him the title with grandmas signature.

It’s sellers responsibility to get car smogged.
Don’t let grandma forget to sign a Release of Liability and turn into the DMV or AAA within 5 days of sale.

ALWAYS, ALWAYS call a first time buyer no matter how small the purchase. This simple phone call is the single most important step in fraud prevention. It alone will wipe out more than 80% of the fraud.

Address and Telephone number match. In many cases we are able acquire an address from a telephone number by performing a reverse lookup on the buyers phone number using bigfoot.com . Keep in mind that bigfoot’s data is not always accurate and the address may not match but it will get you in the proximity. This simply means that we need to take additional steps for the confirmation. The phone type is not always accurate either, if you feel uneasy about the transaction and want to be sure of the phone type then I recommend using maxmind.com, it is a paid service but worth every penny. Maxmind will also provide more detail pointing out the anonymous types such as pay phones and store purchased pre-paid cell phones.

If it is a land line and that address also matches the paypal confirmed shipping address then we are looking good. Simply make the phone call to make sure that the phones owner is really making a purchase. The phone call is also used to insure that a child is not attempting the purchase.You would be surprised with the number of payment reversals we have had as a result of children hijacking their parents paypal account or Credit card. Cell phones may be acceptable depending on the situation and other provided information. We simply are not able to get enough info on cell phones to concrete any deal.

GEO IP lookup. Website owners should capture a buyers IP address and perform a geographical lookup on the IP address. Again I recommend using maxmind to do this. I have tried using many other lookup web sites and have found maxmind to be the most accurate. If GEO IP lookup resolves to the proximity of the buyers confirmed address and phone number then we can assume that this is a valid purchase. AOL IP’s will not resolve properly because of their funky proxy system, otherwise maxmind will see through most other proxy systems or at least inform you of it. In this case one may want to be stricter on some of the other prevention measures. In any case if it resolves to a country other than the buyers country you should always refuse the order.

Internet service provider email address ( Email confirmation )

I typically only use this if I am still a little concerned about the purchase and the buyer has provided a cell phone number or the GEO IP LookUp was unsuccessful. Simply ask the buyer for their Internet service provider email address, send them an email and ask them to reply to it. Do not rely on hotmail, gmail, yahoo etc email addresses. Anyone can get those and they serve no purpose in regards to security.

Online ID Verification services

If all else fails you are down to 2 choices. #1 Reject the order or #2 Ask the buyer to register with an online ID verification service. For gamers I recommend using TrustWho.com otherwise try Verisign.com

You will need to go to DMV with the bill of sale. They can run a check on the bike and make sure of ownership. The seller may have to sign some forms but you should be able to get a title. Baring any problems with ownership and signatures, once the bike is in your name you can get it insured.

There is a process to do this, your local Dept. of motor vehicles will give you the appropriate paeprwork to do this. It takes a bit of time, but it can be done. Each state is a bit different. How to Begin a Winning Sales Letter

In a recent Sunday issue of the New York Times, I came upon a 12-page insert promoting The Economist, a wonderful magazine that I’ve enjoyed for years. The production values of The Economist’s slick piece, designed to attract new subscribers, were absolutely first rate. The insert featured four-color printing, attractive art direction, a terrific “free trial” offer, etc.

There was one big problem, however. The two-page pitch letter, that was part of the mailer, sounded as if it was written by a non-native speaker. I just don’t get it. I wish someone could explain to me how a letter like this ever sees the light of day. Here . . . read the first two paragraphs of the letter yourself and see what YOU think of it:

“Dear Colleague:

There is no doubt that The Economist is enjoying an unprecedented dynamism in the latter half of its second century. Its unlikely name is bandied about and bragged upon in the highest places. Our essentiality has arrived. The interdependency of the world has been brought home all too clearly. The case for global intelligence has been  made. The Economist provides it in a unique and refreshing  way. Thus, our reputation.”

See what I mean? Instead of trying to appear so darn erudite, (and winding up sounding muddled), the copywriter of the letter should have stuck to basics. How should the copywriter have begun the letter? More importantly, how should YOU begin YOUR next sales letter? My advice to all non-professional copywriters is to come out swinging. Make your offer right up front!

Let me show you how much better the Economist letter would  have been had the copywriter skipped the fluff and led with the offer:

“Dear Friend:

Bill Gates, the Chairman of Microsoft, recently said, “The magazine I spend most of my days reading is The Economist.” Larry Ellison, CEO of Oracle, said, “I used to think. Now  I just read The Economist.”

When buying a grade horse, should I get a bill of sale or is a personal check enough?

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. Something just doesn’t feel right.

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

With my sons 21th birthday fast approaching he was desperate to have his own house but he couldn’t afford the costly bills that come with having a house of his own. here is the thing you do not need the bill of sale. contact the finance company that financed the car originaly and request a duplicate lien release form from them then go to the N.C. dmv and get a MVR 4 form and complete it use the section that says reassignment of title by registered owner to sign the vehicle over to your spouse. North Carolina no longer calculates the amount of road tax you will pay based on the sale price of the vehicle they got wise to that old trick but if you sign your MVR 1 form stating you are giving the vehicle to a spouse or child then you will not be charged highway use tax you will only be charged the 35.00 tittle transfer fee the 5.00 notary fee and the 28.00 license plate fee. and you will be able to get tags no problem

I think as long as you don’t do anything stupid, you should be ok.
Not save that much? are you serious? depending on the local sales tax and the actual price of the car, this can be quite allot of money. If the actual price is $5000 and they mark the bill of sale as $1000, if the sales tax is 7%, that saves $280

If you’re a small business owner or an entrepreneur, you should be reading this book and devouring it. There’s lots and lots of great examples in here that you are able to, what we call, swipe and deploy; where you can take examples that are working in other industries and customize them for your business without having to go through all the pain and agony of creating messages and finding out what actually is working. Bill has assembled a great book that has lots of working examples.

You can actually get a color CD with all of the examples inside the book. So the CD, alone, is worth, I would say, hundreds if not thousands of dollars, because there are really some great examples inside the book. What I’m going to do today is I’m going to show you two pieces that I actually took directly out of the book.

Inside the book, Bill goes through and talks about one of his most successful campaigns at his menswear store, which was, I believe, a four or a six page sales letter, handwritten with blue ink on a yellow legal pad.

So for one of the programs that we created, we had some high-value targets that did not respond to our first batch of direct mail. And these were some clients that were worth a fair amount of money, so we wanted to take it a few steps further.

We created a handwritten letter. On the outside of here it just says there’s lots of families looking in your market to participate. This is time sensitive. I’m not going to go through the whole thing, but we also had the same thing on the back side, so if you have something, you should have stuff on both sides with instructions letting them know what’s inside.

Inside of here we had, I believe, six pages on a yellow legal pad, and it explained the whole story of how we went to a marketing seminar, and we learned this great new strategy. We implemented it really fast, but we don’t have any redemption locations in your market. We’ve got leads waiting, we’ve got customers waiting to do business, but we need a place for them to redeem our offer.

We wrote the whole story of what happened. We’re at this seminar and we’re learning lots of tricks, so we went into implementation mode, and it’s led us to chaos, and we’ve got lots of customers waiting in markets where we didn’t have a redemption center.

So we talk about that, and because of my huge mistake, you’re going to get a great discount. You’ll be smiling ear to ear, but because you’re helping me, these prices aren’t good enough. So I give them some extra bonuses and discounts. I guarantee that they’ll be happy with the service, and I give them two deadlines on here instead of just one. And then on the back, I’ve got four shameless bribe coupons that they can redeem when they take action before the deadline.

So this went out to, I believe, 250 or 300 high-value targets and it also went with an order form. The response on that was pretty good. I think we ended up off of this one with between twenty and twenty-five centers responding off the first piece. So that was a nice piece.

Now the next piece went out, and this is another thing taught in the book, about sequential marketing instead of just one shot marketing. So this was a part of a three-step campaign.

The second piece was what we call the garbage can mailer. So two things. It was sequential, so it was the second piece, not just one. Secondarily, it was 3-D, so this is what they call lumpy mail. And if you get a garbage can in the mail, you almost have to open it, because you’re not sure what’s inside it here.

Essentially what we tell them in here is that this is their last chance . Warning! Last Chance Opportunity. And we talk about how a few weeks ago, we mailed them information but they haven’t responded yet, and we’ve got lots of people with busy, busy, businesses as a result of this program.

We also then show some proof, where we list a whole bunch of the participating redemption centers. And then back and front we added a second piece.

We sent this out. We got another fifteen to twenty responses off of that. So when it was said and done, the first two pieces of this netted us over a 10 percent response, which as anybody knows in direct mail is pretty phenomenal.

There is a process to do this, your local Dept. of motor vehicles will give you the appropriate paeprwork to do this. It takes a bit of time, but it can be done. Each state is a bit different. In California, there is a rather large stack of forms to complete. It is done to make sure, no previous owner has claims on the vehicle, hope this helps. Fyi. it is not a slam dunk easy thing to do!

Is it ok to write out a bill of sale for my 25 year old mobile home?

My late uncle died without a will, and his father left it up to my late uncle’s brother to take care of everything. My late uncle’s brother told me i could take control of the full size mobile home. The mobile home is over 25 years old with no title in the state of Alabama, and i am wondering if would be legal to write out a bill of sale to sell the mobile home to someone.

In most states if the mobile home is in a leased space mobile home park, or its just the mobile home that is being sold then you write out a bill of sale.

If the mobile home is on land and the land is part of the deal then its a real estate transaction.

GENERAL INFORMATION:

Manufactured homes are governed according to the Code of Alabama 1975, Title 40 Chapter 12, Section 255. Manufactured homes must be registered within 30 days of purchase. Failure to comply with the State law could result in the issuance of a penalty of $10 as well as citation fee of $15. Homeowners who fail to obtain and/or correctly display a manufactured home decal, if found guilty in court, can be fined up to $500.00, and/or sentenced up to six (6) months in the county jail under Section 40-12-255.

Manufactured Homes must be registered in the License Department or the Tax Assessor’s office. Decals will be issued in the appropriate office. The License Department decal is a rectangle with the outline of the state of Alabama; the Assessor/Collector decal will be square with Ad Valorem Taxes printed on the decal.

REGISTER WITH TAX ASSESSOR IF:

The Tax Assessor/Collector will register the home if the land and home are in the exact same names. If the home and land were purchased as a package, there will be no sales tax collected; however, if a title fee is due, this must be collected. If the land and home are exact and the person lives in it, you will register with the Assessor (homestead can be claimed). If the land and home are exact and a family person lives in the home, you will register with the Assessor at a higher tax rate.

The License Department will register the home if only the home is owned and not the land. Also, if the home is rented, it must be registered in the License Department. Sales tax for Manufactured homes is 2%.

Sales Tax will be collected on the amount reported on the Bill of Sale. No Bill of Sale is to be accepted for $1.

TITLES:

Any Manufactured Home 1990 or newer must have a title.

If purchased from an Alabama dealer, the title application should be provided by the dealer.

If purchased from an individual, the title must be signed and the License Department will apply for the Title. Be sure to check lienholder information.

DELINQUENT/CITATION/PENALTY:

Once a year, the Tax Assessor and License Department inspect all manufactured homes in Madison County. Each homeowner must have their decal displayed. If not, a citation is issued and mailed to each homeowner.

Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. But the financial adviser is asking me for a Bill of Sale. To me the bill of sale (especially signed) would be fraudulent because it would not actually be sold until the transaction of money and pink-slip between my bro-in-law and me.

It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

I have never been charged with a felony, no domestic stuff either, but I was denied when I tried to purchase a handgun. I have some battery charges, but nothing involving weapons. If you have no felonies and no other charges related to crimes committed while in possession of a firearm, and you’re over 18, your purchase of a firearm wouldn’t violate any Georgia laws that I’m aware of.

It is COMPLETELY false that only federally licensed dealers can sell firearms. There is no such law and there could never BE such a law.. If I legally own something I can sell it to anyone legally authorized to purchase and possess it, including a handgun. If it crosses state lines that’s another story.

You do not need a permit to purchase a handgun, registration of any handgun or a license to carry unless you’re going to carry a handgun (concealed or openly) outside of your own property, other than in a private motor vehicle (in plain sight or in the glove compartment) or openly carrying for hunting or fishing (with written landowner permission, if you’re on someone else’s property).

I just moved back to North Carolina and went to register car. I had the title of the car but misplaced the bill of sale. The dealership was taken over a few years ago and I am still hunting down records. The car was paid off in 2002. Can I sell it(car) to my spouse for a dollar?

here is the thing you do not need the bill of sale. contact the finance company that financed the car originaly and request a duplicate lien release form from them then go to the N.C. dmv and get a MVR 4 form and complete it use the section that says reassignment of title by registered owner to sign the vehicle over to your spouse. North Carolina no longer calculates the amount of road tax you will pay based on the sale price of the vehicle they got wise to that old trick but if you sign your MVR 1 form stating you are giving the vehicle to a spouse or child then you will not be charged highway use tax you will only be charged the 35.00 tittle transfer fee the 5.00 notary fee and the 28.00 license plate fee. and you will be able to get tags no problem

A third party will offer a bank to pay the amount left on the loan if the borrower is no longer able to make the loan payments. To make the third party willing, the bank will pay a premium to the third party, similar to premium payments to insurance companies. Here is an example:

Bank A decides to provide Minesh the Borrower with a 30-yr fixed mortgage of $250,000 to purchase a home. Bank A cannot afford to lose $250,000 if Minesh is unable to pay, but the bank can afford to risk losing $100,000 of the principal on the mortgage. Now, since Bank A still cannot afford to lose the remaining $150,000, it offers to pay a third party company $1000 every three months if the third party company agrees to pay Bank A $150,000 in the event that Minesh Borrower is unable to pay his mortgage. It is similar to insurance, without the insurance regulations – a way for banks to hedge against financial loss from borrower default.

The added security of CDS’s to our mortgage lending environment instigates and encourages lending to home buyers, as mortgages protected with CDS’s are more likely to be issued, and are more marketable for re-sale. Anything that makes mortgages more appealing, facilitates mortgage approval, and thereby, makes home purchasing more frequent and attainable. In many situations, loans are not made without credit default swaps.

So, what does this all mean? The added regulation on CDS’s may remove their safety net from mortgage lending, increasing associated mortgage-default risk. In order to balance or reduce risk, costs to borrowers will increase. At times, the lack of CDS’s will lead to such an increased default risk that any prospects of bank profitability are eliminated, leading to declined mortgage applications.

Why are Credit Default Swaps the target of legislative assault? Large corporations exposure to certain CDS’s such as AIG- America’s insurance giant- led to corrosion of corporate balance sheets. AIG sold a number of CDS’s to banks all over the world, providing bank protection in the event of mortgage default. With nearly $440 billion of coverage provided in the form of CDS’s to banks, AIG faced a crises when the American people simultaneously began defaulting on mortgages, as the climbing of the federal funds interest rate provoked many newly issued floating-rate mortgages to blunder. Without enough cash to maintain its side of the CDS agreement to cover the loss on mortgage default, AIG liquidated many other, profitable assets out of necessity, killing the company’s financial well being. Unable to provide banks in need with the promised cash recuperation, and also unable to maintain the promise of a security blanket against default to other financial institutions sent the banking system into a frenzy. Such negligence left the company vulnerable to catastrophic loss. For AIG, the catastrophe was a progressive climb in interest rates. I submit that regulation preventing companies from pursuing too many of one category of CDS’s could protect conpanies, banks, and individuals from the risk of catastrophic loss.

As a result of the new legislation, the mortgage game will be more challenging, as a loan without the security of a Credit Default Swap is less marketable, and therefore, less attractive to banks. There is little money to be made off of non-CDS supported mortgages unless the borrower brings accompanying financial strength that dispels the need for added, hedged security. Also, the loans will only be designed with strength, including only financially strong debtors and loans built off strong equity positions (large down payments).
