Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

In the end, the homeowner receives a permanent reduction in their principal balance, often to the tune of a few hundred thousand dollars, and the hedge-fund makes a profit on the difference between the purchase price and the new 95% of market value principal balance. A true win-win scenario for everyone. Even the banks walk away ahead as they have now rid themselves of future foreclosure risk and have the influx of capital to put to work in their business, which is lending. Homeowners who are disenchanted by the loan modification process and restrictions placed on them and want to stay in their homes, rather than just walk away from their property, or be forced into a short sale now have a viable option which appears to be far superior to either.

Attach a certified copy of your letters of administration to the bill of sale. It will probably be required anyway showing you have authority to act on behalf of the estate.

Check with a mobile home dealer and they may be nice enough to assist you.

The first POS systems appeared in the latter parts of the 1800s. In1870, James Ritty was fed up with his dishonest employees who pocked cash instead of depositing it with the OH Saloon in Dayton. So, he started to search for ways to automate the cash registry of the Saloon what specialized in pure Whiskies, Wines and Cigars.

 

It was during a trip that Ritty took on a ship when he got the idea of an automated mechanical cash register. When James returned of Dayton he teamed up with his brother John and got to work making the first automated mechanical cash register that recorded transactions at the saloon. They called this patented device the ‘Ritty’s Incorruptible Cashier”.

 

This first cash register allowed a clerk to calculate the transaction and return the correct amount of change to the customer. The mechanical cash register had a cash draw that opened each time a transaction was negotiated to allow the clerk to make changes to the deposit by putting in cash and taking out the correct change before the draw was closed. It was mandatory for the draw to open and close before the next transaction could be carried out.

 

The cash register allowed the streamlining of the accounts to be maintained. These were the basic mechanical cash registers and nothing much changed for a very long time. Then the electronic cash registers come in frontier.

 

The mechanical cash registers had many drawbacks. For example, they could not maintain a record of the inventory in the store. If an item was sold the item would have to be manually removed from the inventory. Cashiers had to manually type in the amount. This was not the case with the electronic cash register that was fully automatic and allowed for streamlining of the checkout system.

 

Electronic cash registers had an additional tool called the “bar code scanner”. The product just had to be passed over the barcode reader and the cash register would automatically calculate the amount and add it to the bill. There was little need for typing in the amount of the item being sold. One more action the electronic cash register carried out was to automatically delete the item sold from the inventory. This reduced a lot of work for the staff on the shop floor and thus saves time.

 

The cash register has come a long way in history from the time it was invented. From the simple mechanical cash register to the today’s complex networked computerized electronic cash register, the cash register obviously does a lot more than just manage cash.

How do I get a title for a manufactured utility trailer in NC w/o an Official bill of sale or title to trans?

I bought a utility trailer w/o a title from a couple from S.C. (they moved here to NC about a year ago) The orig owners lost the bill of sale a long time ago, and they never registered it because tags and titles are not required on trailers in SC. I don’t know what to do. DMV has not been very helpful.

Some times you have to get an attorney. But lets try this first.

First off always be very nice as these people can make you jump through more hoops than a circus tiger.

Call SC and ask them if they require titles on their utility trailers, make your you have all the info off that trailer in front of you. Serial number, how may axles and how long it is.
If they don`t require titles and a bill of sale will work in SC then get a hold of the couple that sold it to you and have them just make out a bill of sale from them to you. Now with that in hand and the knowledge that SC is a non title state, You take this info to your state and explain to them you just bought a trailer from a non title state and you need a state title and vin tag put on making it legal in your state. Now probably you will have to buy a form that will cost you 10 to 25 bucks, where I live it is 25 dollars. The highway patrol will fill out the form send it in and the state will send back a vin tag for your trailer. You will have to go back to the hwy patrol to have it stapled on.

If it dosn`t look like this will fly then, try and change the appearance of the trailer to where it looks home made and apply for a home made title and vin tag. The one thing you for sure want to do is make sure you do not do anything illegal. They will catch you and bust your a– good if they catch you doing anything illegal.

One more thing. Call around to some of the attorneys and find out which one is doing titles in your town. Find that attorney and hask him who is doing the most tiltes with him tell him your problem and see if he will hook you up with a wrecker company or some pwing business that applys for titles ever few months. Once you know who is doing titles go to them and see if you can add your trailer on to the next batch they send off for new titles on. These towing companys tow peoples vehicles and if the owner does not pay the bill then after about 90 days the towing company can get a new title in their name and sell the vehicle for the tow bill I use to be in the towing business and have done this several times. In fact another fellow and I use to lump our stuff together so as to save on attorneys fees. Most attorneys cahrge a set fee whether it is one title or 100 titles. This is probalby the safest route for you to go especially if the state dmv is giving you a bunch of trouble.

One trick I use to use when dealing with the dmv in my state is, every person I talked to and every thing they said I made a note of it. Imadde sure to ask their names. When you ask their names they get off their azz and start doing thier jods instead of giving you the run around. Even if you call the hwy patrol do the sme thing get their nnames and write down what that person stells you so you can reference back to it later.

Is it ok to write out a bill of sale for my 25 year old mobile home?

My late uncle died without a will, and his father left it up to my late uncle’s brother to take care of everything. My late uncle’s brother told me i could take control of the full size mobile home. The mobile home is over 25 years old with no title in the state of Alabama, and i am wondering if would be legal to write out a bill of sale to sell the mobile home to someone.

In most states if the mobile home is in a leased space mobile home park, or its just the mobile home that is being sold then you write out a bill of sale.

If the mobile home is on land and the land is part of the deal then its a real estate transaction.

GENERAL INFORMATION:

Manufactured homes are governed according to the Code of Alabama 1975, Title 40 Chapter 12, Section 255. Manufactured homes must be registered within 30 days of purchase. Failure to comply with the State law could result in the issuance of a penalty of $10 as well as citation fee of $15. Homeowners who fail to obtain and/or correctly display a manufactured home decal, if found guilty in court, can be fined up to $500.00, and/or sentenced up to six (6) months in the county jail under Section 40-12-255.

Manufactured Homes must be registered in the License Department or the Tax Assessor’s office. Decals will be issued in the appropriate office. The License Department decal is a rectangle with the outline of the state of Alabama; the Assessor/Collector decal will be square with Ad Valorem Taxes printed on the decal.

REGISTER WITH TAX ASSESSOR IF:

The Tax Assessor/Collector will register the home if the land and home are in the exact same names. If the home and land were purchased as a package, there will be no sales tax collected; however, if a title fee is due, this must be collected. If the land and home are exact and the person lives in it, you will register with the Assessor (homestead can be claimed). If the land and home are exact and a family person lives in the home, you will register with the Assessor at a higher tax rate.

REGISTER WITH LICENSE DEPARTMENT IF:

The License Department will register the home if only the home is owned and not the land. Also, if the home is rented, it must be registered in the License Department. You must also pay the appropriate sales tax as well as a title fee if purchased from an individual or an out-of-state dealer and home is a 1990 or newer.

BILL OF SALE:

A Bill of Sale is required on all transfers of manufactured homes sold by individuals. If purchased from an Alabama dealer, we must see the bill of sale to verify sales tax has been collected. If purchased from an out of state dealer, a copy of the bill of sale must be made and the appropriate sales tax collected.

Sales tax for Manufactured homes is 2%.

Sales Tax will be collected on the amount reported on the Bill of Sale. No Bill of Sale is to be accepted for $1.

TITLES:

Any Manufactured Home 1990 or newer must have a title.

If purchased from an Alabama dealer, the title application should be provided by the dealer.

If purchased from an individual, the title must be signed and the License Department will apply for the Title. Be sure to check lienholder information.

DELINQUENT/CITATION/PENALTY:

Once a year, the Tax Assessor and License Department inspect all manufactured homes in Madison County. Each homeowner must have their decal displayed. If not, a citation is issued and mailed to each homeowner.

How can I revoke a BILL OF SALE for a vehicle that was written as a DONATION?

I wrote the Bill of Sale as a donation, thinking that I could write it off as a tax deduction, then I found out that the donation has to be made to an organisation that has a taxpayer ID. Now the guy doesn’t want to pay for it. Is there a legal way I can retake possession of the vehicle? Can I take the plates off the vehicle and visit the DMV and get them to help me?

If you gave him the title, you can’t do anything. Anyone with an ounce of sense knows the IRS needs proof that the vehicle was donated to a 501 (C) 3 charity. You don’t get that when just giving it to someone. The DMV wont and can’t do anything to help you.

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

here is the thing you do not need the bill of sale. contact the finance company that financed the car originaly and request a duplicate lien release form from them then go to the N.C. dmv and get a MVR 4 form and complete it use the section that says reassignment of title by registered owner to sign the vehicle over to your spouse. North Carolina no longer calculates the amount of road tax you will pay based on the sale price of the vehicle they got wise to that old trick but if you sign your MVR 1 form stating you are giving the vehicle to a spouse or child then you will not be charged highway use tax you will only be charged the 35.00 tittle transfer fee the 5.00 notary fee and the 28.00 license plate fee. and you will be able to get tags no problem

Having A Quick Home Sale

For a quick sale, you need to make your home look better than the competition. When I look through pictures of real estate online, I see so many pictures of messy rooms. People haven’t taken the time to even tidy up a little before they or their agent take the photos that will be any buyers first impression. So often in these photos, the tv’s are on and there are cans of pop on the coffee table. This looks so ugly! So I think the easiest way to make your home look better than most is to simply clean it up.

First off, tidy the surfaces. Clearing away dishes and your daily clutter is the bare minimum you can do to at least let a buyer see the house that sits underneath it all. Then make the beds. If you want to do more, and really you should, take a hard look around. Are your surfaces covered in decorations? If so, are these here because they enhance the room, or because they have sentimental value? If the answer is the latter, get rid of it, at least for the time being. Start packing, even if you don’t know where you are going to move. You will be glad you did for at least a couple of reasons. First, potential buyers won’t be distracted by your clutter, and second, you’ll be that much further along when it does come time to move.

Look around the home again. Is it crowded? If you have more furniture than you absolutely need, or than fits comfortably in the room, consider packing it up also. The same goes for projects you’ve been working on. If you aren’t actively working on them, put them away until after the move. Renting storage space is a good idea once a critical eye shows you just how much you can remove from your home while it is for sale.

But all this doesn’t mean emptying your home to achieve that un-lived-in feel. On the contrary, you want your home to be cozy. There is a balance between cluttered and cozy, and you must find it. Once you’ve done a thorough clean-up, which obviously includes making bathrooms and kitchens shine (these are key selling features and should not be overlooked), make the beds and toss the pillows neatly on the couch. Position your remaining decorations in a way that truly accents the room, such as placing two dramatic candle sticks on the mantel, or even a teddy bear on a tidy bed.

To help make the rooms feel live-able and warm, turn on the lights. So often, these real estate pictures I mentioned at the start of this article have been taken at night. Dark windows or even closed blinds make a home look dreary to me right away. Have your agent come by during the day to take pictures of your home, and be sure to take advantage of both natural and artificial light to make your home appear bright and desirable.

When it’s time for your home to be shown, play some quiet, mellow music during showings, but by all means, leave the tv off. Consider creating some pleasant smells, as these too impact a buyer’s first impression.

By making your home stand out, you increase your chances of a quick sale, at the rate you are asking. So do yourself a favor and put in that extra effort. You’ll be glad you did.

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

Owning my own company, I can easily relate to this as we have had our fair share of poor vendors whom we paid a lot to only to see mediocre results. On the surface, they were great people and instilled confidence in you (though, I always am too trusting), then once the check cleared, they become unresponsive and gave us the perception that they no longer cared.

Now, the “vanishing act” as I refer to it will never make a sales person successful. The first reason why is that they will cease to obtain any repeat business or recommendations. These days, cold-calling is nearly dead and industry contacts are king. Companies are willing to pay premium compensation packages for those sales people who come equipped with a solid, industry pertinent book of business and a good reputation. Moreover, these types of sales representatives are more prone from hoping from industry to industry and, thus lowering their value on the open job market.

I would not disagree that account management can be tricky as you have to juggle new business acquisition while maintaining current accounts. Also, most companies, unless you are very high-up in the organization, do not provide you with a dedicated account manager / administrative representative. Therefore, you have to be exceedingly organized. Now, some people favor a CRM system (customer relationship management software) while others are quite old-school and prefer a pad of paper and a pen. Although I am still relatively young, I opted not to by a CRM system for our office as I find them to be too formal and if the sales representatives are truly working as a team, a basic software is not going to make a difference either way.

While new business acquisition will pay the bills and is extremely important, as an account executive, you must be aware that people have certain expectations after purchasing a product. Though, the good aspect of some clients is that they will set forth clear account management expectations following their purchase. Knowing the client’s goals for after purchase management will allow you to meet them and if you do, you will reap the benefits. You may not see increased business today or even tomorrow. Regardless, practice good account management enough and you will work your way up the sales ladder and be where you strive to be professionally.

Would a bill of sale for a handgun be illegal?

I have never been charged with a felony, no domestic stuff either, but I was denied when I tried to purchase a handgun. I have some battery charges, but nothing involving weapons. If somebody sells me a handgun and gives me a bill of sale, would that person be guilty of anything illegal? In case it matters, I live in GA and I am 30 years old.

If you have no felonies and no other charges related to crimes committed while in possession of a firearm, and you’re over 18, your purchase of a firearm wouldn’t violate any Georgia laws that I’m aware of.

It is COMPLETELY false that only federally licensed dealers can sell firearms. There is no such law and there could never BE such a law.. If I legally own something I can sell it to anyone legally authorized to purchase and possess it, including a handgun. If it crosses state lines that’s another story.

You do not need a permit to purchase a handgun, registration of any handgun or a license to carry unless you’re going to carry a handgun (concealed or openly) outside of your own property, other than in a private motor vehicle (in plain sight or in the glove compartment) or openly carrying for hunting or fishing (with written landowner permission, if you’re on someone else’s property).

When buying a grade horse, should I get a bill of sale or is a personal check enough?

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

How To Be Prepared When Structuring A Private Residential Mortgage Note For Re Sale

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

I have come across many note sellers that ignore the advice of being prepared. Properly structuring a note for resale can be the difference between selling the note fast and with little friction as opposed to selling yourself short or worse, not selling the note at all. In order to properly structure a mortgage note for resale is as follows:

1) Get the biggest down payment possible. 25% is the Note Buyer’s ideal amount in a perfect world although, you can definitely get away with 15% – 20% if need be. Anything under 15% equity becomes very risky for a Note Investor. In the case of a down payment under 14% equity, you will have a very tough time getting a high bid on that note. Anything under 10% down, will unlikely sell at all.

2) Make sure you (the seller), pull credit on the potential borrower. 600 FICO score – 700 FICO score would be ideal. Remember; the worse the credit score is, the bigger the down payment you should require! Make sure you keep a copy of the credit report so you may present to the mortgage note investor underwriting the transaction. As far as credit scores, 650 or higher is considered great to excellent credit. 610-649 is good, 609-590 is fair 589-500 is poor and below 500 – don’t even bother. Also try to gather D.T.I. or Debt to Income information from the borrower as well. How much money she/he has coming in per month verses what dollar amount is going out per month. A standard credit report will show you what the borrowers monthly bills are. All you need to do after that is get an accurate dollar amount of what the borrower truly makes after taxes. This way there will be no surprises for you or the Note Investor and this will insure you the highest bids out there! 45% is the max D.T.I. ratio you should allow. This means, if the borrower’s income is $5,000.00 per month, 45% DTI ratio would be $2,250.00 (5,000 x 0.45 = 2,250.00) in debt per month. The borrower only owes 45% of what they make to monthly debt.

3) It helps tremendously if the seller orders and completes an appraisal before submitting the note to a Note Buyer. The reason being, presenting an exact legal appraisal to a Note Investor allows for a more accurate bid, thus a hassle free transaction. This way when the note is underwritten, there will be no surprises on the collateral property whatsoever. This step is not necessary although, by doing this your are drastically increasing your chances of a very smooth note sale.

4) Include a high interest rate with the shortest term possible. Meaning, be sure that your borrower can afford the payments at the shortest term she/he can legitimately agree to.

5) Try to keep the loan under a 10-15 year payback date. Anything over 12 years usually takes a much steeper discount then say a 10 balloon. The Note Investor generally likes to be out of an investment in 5-10 years. Ideally, if your borrower situation permits, 5-10 is the first choice.

6) Include a prepayment penalty based on your states regulations and laws.

Please keep in mind; the above information is just a guide. If you have any legal questions about mortgage origination laws in your state, please consult a licensed mortgage broker/banker (in your state) or an attorney. Always be prepared!

you need to take the bill of sale and the title to the DMV or in some cities you have to go to the clerk and recorder, You may or may not again depending on where you live have to have insurance first. I have a motorcycle registered in montana and I have never ridden it and therefore it is not insured but I still got the registration and plates. you might try calling them before actually making the trip.

It\’s really a buyers market all over this country, and there\’s not a lot of prospective buyers in many, many markets.

However, if it\’s a 20% to 25% commission with a continuing income component, have a closer look prior to rejecting it. There are two key reasons to think about this type of commission plan:

1.) By the end of the year, you will get a great deal more cash with the same sales volume.

2.) When you have a bad month, it is not the end of the world. Your residual commission still gets paid out.

Remember, the commission-only sales jobs market is not a survival strategy for jobless sales agents. The business is still trying to sell and still depends on experienced sales staff to get the job done.

If you have always aspired to be a sales person, but have no experience, or you are not a really productive salesman, do yourself as well as the company a favor. Do not apply for the sales rep job. This is a strategy for the skilled sales person only.

It can be a very challenging and depressing process for an unemployed sales professional to find a position doing the work they love. Sorry to say, many overlook possibilities because they reject commission-only sales jobs out of hand, without digging into the whole comp plan.

Commission-only sales jobs , with a recurring commission component offers the successful salesperson the opportunity to ramp up income quickly, while enjoying income protection on a slow month. There are no income caps and no holdbacks. The days of \”one sale, one commission\” are over with this plan. Now, go after the sales jobs that provide the income you need.

If you are trading even, you should still have some kind of written agreement in addition to the signed title. Although it is not a requirement, a bill of sale is a precautionary measure in the event you loose the title and have to ask the previous owner to apply for a duplicate. Hi. I bought a truck from a private party and found out afterwards that we should have had the bill of sale notarized for vehicle registration purposes. Is there a way I can get it notarized after the fact by, for example, signing it again in front of a notary? Would we both have to sign it again? The other party lives pretty far away.

As a notary in the state of Iowa, I would say it total depends on the notary you ask. You would be asked for proof of identity and would have to sign again – either on the bill of sale or a separate piece of paper to verify the signature. You may be able to get a notary to simply notarize both signatures, however that’s a good way to lose your notary privileges.

When buying a grade horse, should I get a bill of sale or is a personal check enough?

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. Something just doesn’t feel right.
If you think I need a bill of sale, what should it all include?

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)
