What is a Bill of Sale Form

Saturday, March 13th, 2010

As American’s, and leaders in auto bill of sale, vehicle bill of sale, and property bill of sale forms, we know the importance of protection, especially personal protection.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

A bill of sale is a relatively easy form to fill out that doesn’t require a lawyer. It allows you to legally transfer the title of an asset from one individual or entity (i.e. business) to a new owner. In all, bills of sale are and include the minimum amount of information necessary to legally confirm that the transfer of the ownership of an asset has taken place. Also, the bill of sale is tangible proof that affirms that the transaction was conducted in a legal manner and that both parties agreed to the transaction.

To minimize the incidence of fraud, as well as providing owners protection from illegal property seizing created the need for a bill of sale. Our current bill of sale has its origins from the 19th century. It came about because of compliance with regulations that were intended to prevent abuse of existing laws and to protect both owners as well as consumers.

Today it essentially does the same thing. It is a document drafted by the seller that is written with all the necessary information appropriate for the details of a sale. Some information it still requires even today is the names and identifying data of both the buyer and seller. This has and still always includes the legal name and permanent physical address of both parties involved. Also, even today a brief description of the item that is being sold will be included.

Other kinds of data that goes on a bill of sale is any identifying marks such as the serial number, VIN number, etc. Another thing that is always included is the price of the item. The document is considered complete and legally binding at the point both the buyer and seller sign it.

A first rule of thumb many say to consider is that “you should never sign anything until you fully understand and agree upon the written terms and conditions”. Another one is, “don’t sign anything unless there’s a bottom line price”.

We have Bill of Sale Forms with instructions that make it easy to do-it-yourself without the need for a lawyer. All of our legal forms do not require a lawyer.

Why You Need an Auto Bill of Sale Form Before You Buy or Sell a Used Car

Friday, March 12th, 2010

Selling or buying property or a vehicle can be confusing and stressful enough, without the added worry associated with not knowing your rights. Protect yourself with a professional Bill Of Sale.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

It is important to complete an auto bill of sale form when selling or buying a used car. For the seller, an auto bill of sale form provides proof that

title to the used car has been legally transferred. For the buyer, the auto bill of sale form documents the purchase of the used car.

The auto bill of sale form should contain:

1. name and address of the buyer;

2. name, address and signature of the seller;

3. complete vehicle description, including the Vehicle Identification Number (VIN);

4. description of trade-in, if any;

5. purchase price of the vehicle.

Auto bill of sale forms are required in many states to register the newly purchased used car. These states usually require a state specific auto bill

of sale form that documents specific information such as the purchase price for tax assessment or to obtain the actual mileage/odometer reading of the

used car. A generic auto bill of sale form will not be accepted in these states. You will need to obtain a state specific auto bill of sale form.

To register a used car in other states, all that’s required is that the title assignment section on the title be completed and signed. Many of these

states have added to the title assignment section of the title the information that was previously collected with separate documents (i.e.

odometer disclosure statement, sales price/tax statements, etc.). In these states, an auto bill of sale form is not required to register the used car

and is used by the seller/buyer to document the initial sale/purchase of the automobile.

A promissory note form is a written promise to pay money to someone. A promissory note form can be used to create a legally binding agreement when

financing the sale of personal property, such as a used car. You can complete a promissory note’s payment schedule to fit your needs. You set out

the terms of the loan in a secured promissory note form: how much is loaned, the interest rate, the rate of repayment and the security interest.

Selling An Automotive Vehicle Complete A Full And Proper Bill Of Sale Document

Friday, March 12th, 2010

Selling or buying property or a vehicle can be confusing and stressful enough, without the added worry associated with not knowing your rights. Protect yourself with a professional Bill Of Sale.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

Automobile vehicle seller – ensure that you make out a proper bill of sale. It takes an extra bit of time to ensure that your documentation is in proper and correct out but in the end anything is plain foolish, sloppy and just “false economy”. It’s not unlike the person who bragged they were saving a penny when in the end it cost them many thousands of dollars.

You can more easily and comprehensively close the sale. A properly written bill of sale is a legal document – a contract between you and the seller that all is complete, in order and details agreed to. There is no coming back of the buyer. Simple as that.
It is agreed over and done with.

If the bill of sale is not completed – as an oversight or laziness then the buyer then the buyer can renege on the deal or make extra demands. It becomes a “she said, he said” routine. Why make your life unnecessarily complex when it need not be? Fire departments have fire prevention departments to prevent unnecessary fires that need be.
Why not do the same for yourself by taking the time to write a proper, full and correct bill of sale?

If the paperwork is not complete – then how on earth do you expect the buyer to complete auto financing if need be. Not everyone has the cash on hand, in their bank account to complete a large purchase. Financing may be the only way to get that cash in your hand. A poorly written bill of sale is guaranteed to stop the finance application process dead in its tracks. A properly written one will often just slide through the process like a kid down a water slide. Further a resubmitted finance application is more likely to attract more full attention on its second way through the process than a first timer which goes through more unannounced and in a routine, ordinary manner.

Ditto the same process with registration and licensing of the vehicle. Why waste your time and energy unnecessarily for the chances of having to sort out problems with documentation of the vehicle, when it takes time and energy better spent other elsewhere, allows for customer satisfaction on the part of the car, truck, van or SUV buyer, and allows for post cognitive dissonance on the part of the auto buyer. The purchaser can easily make the choice that something is wrong with the whole process or vehicle and have “wriggle room ” along with just legal cause to demand return of the vehicle along with their money.

Again who needs the unnecessary stress, aggravation and negative effect on your bottom line as well as credibility in your local community or market? Take the time to provide a proper, full and comprehensive bill of sale. In many cases now the document can be easily compiled on computers and printed on computer printers. Business type Laser printers are a wiser choice among lawyers and legal experts. Not only are laser printers cheaper to run overall and faster , their type will not bleed if accidentally wet whereas as less expensive inkjet printers will have their type bleed to a unintelligible mess if a glass of water or cup of coffee has been spilled upon them. More than one legal problem has been facilitated and protracted in this manner. The bill of sale can be written with specific auto industry programs if installed or more simply written in a standard word processor of an office suite program such as Microsoft Office or Open Office or even the simple word processors – the more comprehensive “WordPad” or the simpler “notepad” programs that come installed on most computers. In a pinch a handwritten bill can be written. A handwritten bill is a legal document that is perfectly legal, proper and enforceable by law. Cars, luxury SUVs and even houses have been sold with a simple hand written bill of sale. However such a document is harder to validate and if the buyer appears at either the Canadian border , finance company or state / provincial offices to register the vehicle – then this more apparent bill of sale may be “noted by the authorities” so notes long standing automobile industry analyst and observer Winnipeg based William Simpson. The answer is simply to go into any office supply store and purchase a ready made pre printed blank format bill of sale for you to complete. It must be noted that if you are unfamiliar with the process of completing a bill of sale or are not totally fluent with the process or language then it is not a wise idea to fill out or complete the purchase bill of sale yourself. Take the time and effort as well as impact on your ego – delegate this process, ask help or if need be seek legal or paralegal assistance. It’s all there in your city or marketplace.

It can be said that honesty and integrity are the watchwords in the automobile industry. Take the time to properly complete the legal documentation and bill of sale to any vehicle purchasers. Anything else is just plain poor economy overall and even an accident waiting to happen.

How to Make an Auto Bill of Sale

Thursday, March 11th, 2010

As American’s, and leaders in auto bill of sale, vehicle bill of sale, and property bill of sale forms, we know the importance of protection, especially personal protection.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

An auto bill of sale is a simple form used to document the sale of a vehicle. It’s always a good idea to create a bill of sale for your records even if your local DMV doesn’t require it to transfer the title. This is because it’s a legal agreement and can be enforced if the sale is disputed afterwards. It also can be used to prove the date that ownership of the vehicle was transferred.

To make an auto bill of sale you can go online and download a fillable one for your state. It should include a description of the vehicle and it’s make, model, VIN, and current mileage. Lawyers say to always state that the vehicle was sold ‘as is’ so that your protected even further from future claims from the buyer. I’ve even heard a lawyer joke that you should write no returns and/or exchanges like some stores do on their signs.

Once you’ve created a solid auto bill of sale that you both agree too then sign and make copies for you both. If you want to place it in your county’s records then you both need to go down to the notary to get it notarized.

After you’ve protected yourself by creating a bill of sale you can now sell your vehicle. Your next step though will be to contact the DMV to find out what you need to do to give them proper notice of the sale.

Can you get a bill of sale notarized after it has been signed?

Hi. I bought a truck from a private party and found out afterwards that we should have had the bill of sale notarized for vehicle registration purposes. Is there a way I can get it notarized after the fact by, for example, signing it again in front of a notary? Would we both have to sign it again? The other party lives pretty far away.

Answer
As a notary in the state of Iowa, I would say it total depends on the notary you ask. You would be asked for proof of identity and would have to sign again – either on the bill of sale or a separate piece of paper to verify the signature. You may be able to get a notary to simply notarize both signatures, however that’s a good way to lose your notary privileges.

Once both parties sign the form showing they agree on the stated terms and conditions, the car bill of sale becomes a legally binding document or form, though some states require a notary signature, too. Regardless, it must then be filed with your state’s department of motor vehicles or local county assessor’s office. Different states have different processes for car bill of sale forms or documents, and you’ll need to familiarize yourself with those before your enter into any private party automobile transaction.

Preparing a Bill of Sale for a Used Car

Thursday, March 11th, 2010

Selling or buying property or a vehicle can be confusing and stressful enough, without the added worry associated with not knowing your rights. Protect yourself with a professional Bill Of Sale.

Regardless of whether you’re buying a motorcycle, a used car, or even a powerboat, you will need a bill of sale

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

Preparing a bill of sale for a used car is a professional, organized way to sell a vehicle. Mike Meredith of MSN autos even believes by using one it will help to “maximize the dollars that you put into your pocket”.

When most people think of ways to help their car sell easier using an auto bill of sale usually doesn’t come to mind. Their preparation usually consists of taking the vehicle to a full-service car wash, fixing obvious damage, repairing body damage, touching up the paint, replacing a cracked windshield, and figuring out how to ask for only cash, cashier’s check, or money order. Although these are all good ideas, documenting the item, terms, and sale of the transaction will create trust between the two parties, which will probably do more than anything else to help sell the vehicle.

Creating a bill of sale helps to establish exactly what the terms of the agreement are. Not only that, but you also put it on public record when you notarize it, making it impossible to refute the terms of the sale later on. This document has played a crucial role in civil court before as protection against disgruntled buyers or sellers. That’s why using one is such a common practice now.

Car dealers usually don’t sell their cars “as is”, most likely a dealer will provide a warranty. If your a not a car dealer just sell your car “as is”, your not required to provide any kind of warranty on it. A bill of sale will also include the date of the sale, price, detailed information about the vehicle, and it will protect you against liabilities.

If you want to create your own bill of sale without hiring a lawyer then you can find your state’s form by searching for it online. The car dealerships can just pay a lawyer to create a template that they then mass-produce. You can take advantage of that same kind of mass production by using a legal products provider that has this form. Look for providers with good reputations because that shows they know how to keep their forms up-to-date. A good reputation is a clear signal that no one has had any problems filing their forms.

What all does a bill of sale need to show, if the seller gives you that instead of a title?

What all does the bill of sale need to show in order for it to be adequate to get the bike registered?

This is Texas.

Answer
You still have to get a title before you can register it. You can get a bonded title with a little work. First you need to make sure the bike is clean. If you know a police officer have them run the vin number, or use a site like Cycle Chex (similar to carfax for motorcycles). Next you need to get the bike appraised for the wholesale value – usually costs $100-150. Then you go to a bonding agency – in the phone book under bonds, most likely also an insurance agency, and get a bond on the bike by showing the bill of sale and the appraisal. Typically a bond costs $20 per $1000 of the appraised value. You then take a bond and the bill of sale to a license agency and get the title. It usually takes a few weeks for the state to approve the title. They check the background of the bike too. Finally, you should get your title and be able to license it. Hope it works for you.

State of Arizona Bill of Sale

Wednesday, March 10th, 2010

As American’s, and leaders in auto bill of sale, vehicle bill of sale, and property bill of sale forms, we know the importance of protection, especially personal protection.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

A bill of sale is used to legally document, and protect you when selling any personal property to another person. If you don’t legally document the transaction in writing then there’s no record of the transaction, and therefore nothing to prove you have or had any right over the item. Using a bill of sale will protect the consumer rights of both the seller and the buyer. Using a bill of sale is especially important when your the buyer, but still important for the seller too.

Some things a bill of sale should cover is the date of the transaction, who sold what, who bought it, and how much he or she paid for it. For example, in Arizona both the seller(s) and buyer(s) must notarize all signatures. If the Arizona bill of sale is not notarized then it is void and not legally valid. All parties must also appear before the same notary all at the same time. Although, Arizona state does allow a separate notary acknowledgement to be attached for additional signatures.

Some important things to remember when filling out the legal form is to use “OR” or “AND” in between the specified names if there is more than one name for the owner. Also, if ownership of the property is being transferred to a business entity then the signatures of two authorized persons are required. A copy of the business organizational papers must also be provided. Business organizational papers may include things like Articles of Incorporation, Partnership Agreement, Articles of Organization, ect.

I am awaiting the title in the mail and I have a buyer. What do I need to do exactly to sell the car? When signing a bill of sale do I take my plates, and registration? How does a bill of sale work and what happens with plates and registration when he buys the car from me? Thanks

you do take plates and registration, he takes the bill of sale to the dmv and re-registers the vehicle to himself, you can register your existing plates to another vehicle if you want. or recycle them or toss them in the trash.

What is a Bill of Sale for a Car

Wednesday, March 10th, 2010

As American’s, and leaders in auto bill of sale, vehicle bill of sale, and property bill of sale forms, we know the importance of protection, especially personal protection.

Whether you are a buyer or seller, you can protect yourself with legal documentation through a professional Bill of Sale document.

Not only does it verify that you are the legal owner, but jurisdictions commonly use the bill of sale to determine the sales tax.

When buying a car you should always receive an auto bill of sale with the vehicles details on it, and signed by the seller. This is proof that the vehicle was legally sold to you, and the title has been transferred to you. It’s also important for the seller to keep a copy of the bill of sale because it has the agreed upon purchase price of the vehicle. Having one will prevent any disputes later on.

Every state that I’m familiar with in the U.S. requires an auto bill of sale form to register and tag a new vehicle you’ve purchased. Since some states require additional information, it’s a good to seek out a state specific fill able form if you plan to prepare it yourself without a lawyer. These forms are easy to find and fill out, so a lawyer is not necessary.

Once you’ve found a fill able bill of sale form online for your state then all you need to do is fill in some information. This information includes the vehicle identification number (VIN), the purchase price of the vehicle sold, the full name of both the buyer and the seller, the address of both the buyer and seller, and then it needs to be signed by the seller. Depending on the state you live in there may also be a line on the form for the buyer to sign also.

Documenting the purchase/sale of a vehicle is vitally important in this day in age. That’s why it’s standardized everywhere now. It’s the only way to give your vehicle purchase protection under the law in an organized way. Thankfully, we have kept them simple enough so that anyone can create a bill of sale without the aid of a lawyer. Car lots across the U.S. keep stacks of these forms around and create lots of them daily, but I bet you’ve never seen a lawyer around the lot. That’s because a lawyer isn’t necessary, don’t even think of wasting your money paying some one to prepare one for you.

Can you drive around on a handwritten bill of sale for 30 days in Kansas?

I just bought a car from some friends and they lost the title to the car. I have the means to get the title back, but I need to go places and don’t have new plates for the car. I was wondering if the person that sold me the car wrote up a bill of sale, if I could drive around on that for 30 days in the state of Kansas? I’m pretty sure you can in Missouri, but I live in Kansas.

Answer
No…if you drove over the bill of sale for that length of time there would be nothing left of it. What might be left would probably blow away in the wind. Anyway, you wouldn’t be able to read what was on it.
