It was expected: home sales would drop following the April end of the Homebuyer Tax Credit program. What wasn’t expected, and what has the industry reeling, is the depth of the drop-off. Pending home sales –meaning home sales that are under contract but are not yet closed- fell off 30% in May from its April mark. This drop, to put it in perspective, is the largest single month drop ever recorded, and to make it even more significant, was a 15.9% decrease for the same month a year earlier.

Some would call this drop a falling off a cliff. A free-fall of painful proportions. And though it wasn’t fully unexpected, it still stings.

What it means

Does this level of drop-off mean anything to long-term health or growth of the housing industry? The debate can now be opened up. Many factors came to pass in April, including the Federal government no longer buying up troubled assets, the homebuyer credit coming to an end, and interest rates beginning their rise up from historically low levels.

Another factor that is contributing to the drop-off is the slow economic recovery in this country. Millions of people remain out of work and millions more have been laid off in recent months. It was the perfect compilation of factors that would –each, individually- have led to a decrease in the number of pending home sales in May, regardless of other factors. Yet taken together as a whole, all aggregate factors combined to offer the struggling real estate market the worst single month drop in its history. All this according to the National Association of Realtors (NAR).

How to handle the news

It may seem bleak for many of the nation’s realtors, one thing that can be taken away from this abysmal report is that perhaps the worst is now behind us. News has surfaced that President Obama is considering extending the homebuyer tax credit through September, the government is indicating that growth is steady, which means employers will soon be hiring once again, and the Wall Street Reform bill that is expected to pass and be signed into law can open up lending within many of the nation’s leading financial institutions.

As realtors or mortgage brokers or lenders, May’s numbers are certainly eye-opening, even depressing, but it’s up to each of us to look beyond the number, beyond the factors that led to that drop-off, and see the signs of recovery that surround us everyday.

Is the worst truly behind us?

It is certainly a challenge to remain positive and optimistic as the weeks roll into months and the months stretch out into years, but it is incumbent upon us to continue to think positively, to shrug off the bad, staggering news, and look for the silver linings, wherever they may be hiding. The alternative is to continue to be morose and downtrodden about the economic climate around us, and when that happens, it becomes exceedingly challenging to get other people, most importantly potential homebuyers, to feel positive about the future.

No one truly knows what lies around the next corner of this recession. Depending on whom you ask, you will receive a different answer. And it always seems to be politically motivated. Don’t look to Washington for the answers; look to your own community. Emphasize the positives that have happened over the past year, or the past month, or the past week.

The only way to turn tragically bad news, such as the May pending home sales report, into positive indications is on a local, community-based level and within every community, there are beacons of light shining everywhere; you just need to look harder.

There is a process to do this, your local Dept. of motor vehicles will give you the appropriate paeprwork to do this. It takes a bit of time, but it can be done. Each state is a bit different. In California, there is a rather large stack of forms to complete. It is done to make sure, no previous owner has claims on the vehicle, hope this helps. Fyi. it is not a slam dunk easy thing to do!

I did that when I bought a car from my brother. I gave him $1000 and he wrote the bill of sale for $100.
I think as long as you don’t do anything stupid, you should be ok.
Not save that much? are you serious? depending on the local sales tax and the actual price of the car, this can be quite allot of money. If the actual price is $5000 and they mark the bill of sale as $1000, if the sales tax is 7%, that saves $280

We’re both Realtors, and while our training and connections certainly helped us, we’ve also seen more people than we can count get through short sales and come out the other end smiling.

Just like in boot camp, the first thing you need to work on is your mindset. When you’re facing an underwater mortgage and financial troubles, you have to stop thinking like a homeowner and start thinking like a business person.

What do we mean by that? Well, consider for a moment the way your mortgage lender looks at your house. Your house isn’t memories to your lender, and it doesn’t represent the feeling of accomplishment you had when you walked into your house, key in hand, for the first time.

To your mortgage lender, your house is just numbers and a description on a few pieces of paper.

And while it might be painful at first for you to look at it this way, in a short sale situation you have to look at your house the way the bank does.

My wife, Kristin, specializes in short sales now, and this is a struggle she sees people having all the time. But what’s worse—giving up the house or giving up your financial future?

Because if you’re having financial difficulties and you have an underwater mortgage, that’s the decision you’re faced with right now. If you wouldn’t be willing to risk your life to save your house, why risk your future to save it?

This mental toughness comes into play when you’re listing your home for short sale. Your home is only worth what someone else is willing to pay for it, and not a penny more. So be realistic about this. Follow your Realtor’s advice about the true value of your house. Getting out from under your underwater mortgage depends on it!

Of course, the other place your new mental toughness has to come into play is with your mortgage lender. You’re going to need to stay strong in the face of bank employees who still may not get the fact that ordinary people are now playing by the same rules that large institutions play by. When a mortgage is underwater and people can’t pay anymore, they’re walking away.

Just like large businesses do. This is a business decision, it’s not a moral one. You need to look out for yourself just as your mortgage lender looks out for their own best interests.

And just as you get in awesome shape when you’re going through a real boot camp, in short-sale boot camp, you’re going to have to get your financial house in order. Make sure you’re paying your other bills on time to protect your credit rating. And be sure to close any other accounts you have with your mortgage lender!

With the proper mindset, the proper preparation, and help from your Realtor, getting out from under your underwater mortgage through a short sale can be a relatively easy process. We can’t guarantee it will be a fast process, mind you—it can take up to a year to close a deal. But given that you’ll be saving the money you otherwise would have paid on your underwater mortgage, that wait seems pretty reasonable!

Darin Spindler’s review of Bill Glazer’s outrageously successful book. It’s called Outrageous Advertising That’s Outrageously Successful. This is a bestseller on, I believe, Amazon and a couple of the other top bestseller lists. It’s a great book.

If you’re a small business owner or an entrepreneur, you should be reading this book and devouring it. There’s lots and lots of great examples in here that you are able to, what we call, swipe and deploy; where you can take examples that are working in other industries and customize them for your business without having to go through all the pain and agony of creating messages and finding out what actually is working. Bill has assembled a great book that has lots of working examples.

You can actually get a color CD with all of the examples inside the book. So the CD, alone, is worth, I would say, hundreds if not thousands of dollars, because there are really some great examples inside the book. What I’m going to do today is I’m going to show you two pieces that I actually took directly out of the book.

Inside the book, Bill goes through and talks about one of his most successful campaigns at his menswear store, which was, I believe, a four or a six page sales letter, handwritten with blue ink on a yellow legal pad.

So for one of the programs that we created, we had some high-value targets that did not respond to our first batch of direct mail. And these were some clients that were worth a fair amount of money, so we wanted to take it a few steps further.

We created a handwritten letter. On the outside of here it just says there’s lots of families looking in your market to participate. This is time sensitive. I’m not going to go through the whole thing, but we also had the same thing on the back side, so if you have something, you should have stuff on both sides with instructions letting them know what’s inside.

Inside of here we had, I believe, six pages on a yellow legal pad, and it explained the whole story of how we went to a marketing seminar, and we learned this great new strategy. We implemented it really fast, but we don’t have any redemption locations in your market. We’ve got leads waiting, we’ve got customers waiting to do business, but we need a place for them to redeem our offer.

We wrote the whole story of what happened. We’re at this seminar and we’re learning lots of tricks, so we went into implementation mode, and it’s led us to chaos, and we’ve got lots of customers waiting in markets where we didn’t have a redemption center.

So we talk about that, and because of my huge mistake, you’re going to get a great discount. You’ll be smiling ear to ear, but because you’re helping me, these prices aren’t good enough. So I give them some extra bonuses and discounts. I guarantee that they’ll be happy with the service, and I give them two deadlines on here instead of just one. And then on the back, I’ve got four shameless bribe coupons that they can redeem when they take action before the deadline.

So this went out to, I believe, 250 or 300 high-value targets and it also went with an order form. The response on that was pretty good. I think we ended up off of this one with between twenty and twenty-five centers responding off the first piece. So that was a nice piece.

Now the next piece went out, and this is another thing taught in the book, about sequential marketing instead of just one shot marketing. So this was a part of a three-step campaign.

The second piece was what we call the garbage can mailer. So two things. It was sequential, so it was the second piece, not just one. Secondarily, it was 3-D, so this is what they call lumpy mail. And if you get a garbage can in the mail, you almost have to open it, because you’re not sure what’s inside it here.

Essentially what we tell them in here is that this is their last chance . Warning! Last Chance Opportunity. And we talk about how a few weeks ago, we mailed them information but they haven’t responded yet, and we’ve got lots of people with busy, busy, businesses as a result of this program.

We also then show some proof, where we list a whole bunch of the participating redemption centers. And then back and front we added a second piece.

We sent this out. We got another fifteen to twenty responses off of that. So when it was said and done, the first two pieces of this netted us over a 10 percent response, which as anybody knows in direct mail is pretty phenomenal.

Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

Most critical to the real estate market is how the bill imposes derivative regulation on all U.S. banks. Certain types of derivatives, Credit Default Swaps, are used by banks to hedge or protect against the risk of default or non-payment on loans. In essence, CDS’s reduce some of the risk associated with providing loans, and for our purposes – mortgages. A third party will offer a bank to pay the amount left on the loan if the borrower is no longer able to make the loan payments. To make the third party willing, the bank will pay a premium to the third party, similar to premium payments to insurance companies. Here is an example:

Bank A decides to provide Minesh the Borrower with a 30-yr fixed mortgage of $250,000 to purchase a home. Bank A cannot afford to lose $250,000 if Minesh is unable to pay, but the bank can afford to risk losing $100,000 of the principal on the mortgage. Now, since Bank A still cannot afford to lose the remaining $150,000, it offers to pay a third party company $1000 every three months if the third party company agrees to pay Bank A $150,000 in the event that Minesh Borrower is unable to pay his mortgage. It is similar to insurance, without the insurance regulations – a way for banks to hedge against financial loss from borrower default.

The added security of CDS’s to our mortgage lending environment instigates and encourages lending to home buyers, as mortgages protected with CDS’s are more likely to be issued, and are more marketable for re-sale. Anything that makes mortgages more appealing, facilitates mortgage approval, and thereby, makes home purchasing more frequent and attainable. In many situations, loans are not made without credit default swaps.

So, what does this all mean? The added regulation on CDS’s may remove their safety net from mortgage lending, increasing associated mortgage-default risk. In order to balance or reduce risk, costs to borrowers will increase. At times, the lack of CDS’s will lead to such an increased default risk that any prospects of bank profitability are eliminated, leading to declined mortgage applications.

Why are Credit Default Swaps the target of legislative assault? Large corporations exposure to certain CDS’s such as AIG- America’s insurance giant- led to corrosion of corporate balance sheets. AIG sold a number of CDS’s to banks all over the world, providing bank protection in the event of mortgage default. With nearly $440 billion of coverage provided in the form of CDS’s to banks, AIG faced a crises when the American people simultaneously began defaulting on mortgages, as the climbing of the federal funds interest rate provoked many newly issued floating-rate mortgages to blunder. Without enough cash to maintain its side of the CDS agreement to cover the loss on mortgage default, AIG liquidated many other, profitable assets out of necessity, killing the company’s financial well being. Unable to provide banks in need with the promised cash recuperation, and also unable to maintain the promise of a security blanket against default to other financial institutions sent the banking system into a frenzy. Now, banks had to deal with mortgage default losses alone, and banks not yet facings mass defaults were forced to look elsewhere to protect their mortgage assets against default; however, the protection was now significantly more expensive, considering the shift in the perceived risk surrounding mortgages. The poor investing of AIG funds corrupted its primary line of business – insurance, requiring government intervention, as too many Americans depended on insurance benefits from the giant corporation, requiring tax dollars to protect the insurance benefits, as the company was no longer able to secure funds elsewhere

How will all this affect the real estate market?

Wave good-bye to the ease once associated with CDS issuance and trading – bye, bye. Banks are no longer to engage in “risky” derivatives trading to prevent catastrophe exemplified by AIG – a situation relying on taxpayers for correction. Now that banks are no longer able to deal in potentially risky derivatives trading, the government is, in essence, lifting the ability of banks to offer mortgages to anyone other than the most capable home purchasers. Effectively, banks will only have the availability to approve mortgages with significant down payments (a minimum of 20%) and borrowers with outstanding credit. Such borrowers are not in need of any form of default insurance, considering the debtor’s financial strength.

The Mistake

The stated goal of those drafting our new legislation is to eliminate the use of Credit Default Swaps as a means of speculating the quality of a loan/mortgage, using the AIG example as the evidence of potential catastrophe with speculation in Credit Default Swaps. Oh no no no no, Barney! Mr. Barney Franks! Again you misinterpret the fundamentals of American financing, it was not bank speculation that led to the problem; it was the speculation of the companies investing in CDS’s like AIG who put the system in jeopardy. I submit that government regulation is imposing harsh regulation on a mistaken culprit. The banks simply use the vehicles to purchase security, but the companies supplying the CDS’s speculate that they will collect enough premiums to counterbalance any claims on defaults they may on day need to pay. There is no speculation on behalf of the bank, only hedging for safety measures. The regulation, if any, should be levied on private sale of CDS’s by companies such as AIG – regulating their exposures to certain derivatives trading would be more appropriate. AIG’s mistake was acquiring too many CDS’s of similar complexion, all with sub-prime borrowers, similar loan start dates, and floating interest rates. Such negligence left the company vulnerable to catastrophic loss. For AIG, the catastrophe was a progressive climb in interest rates. I submit that regulation preventing companies from pursuing too many of one category of CDS’s could protect conpanies, banks, and individuals from the risk of catastrophic loss.

As a result of the new legislation, the mortgage game will be more challenging, as a loan without the security of a Credit Default Swap is less marketable, and therefore, less attractive to banks. There is little money to be made off of non-CDS supported mortgages unless the borrower brings accompanying financial strength that dispels the need for added, hedged security. Also, the loans will only be designed with strength, including only financially strong debtors and loans built off strong equity positions (large down payments).

Who’s Affected?

Investors: the practice of flipping houses will no longer have short-term profitability, as the buyers market will be a fraction of it once was, and the frequency of real estate purchase will thereby decline. Real estate investment will shift from seeking gain on house value, to designing strong revenue from cash flow – income properties. With cash on hand and appropriate ratios of debt to equity, investors with cash retain access to low interest rates, unavailable to others, and should be able to use their cash-rich situations to design a cash flow from rent. Interest rates will remain low, as few will have access to the low rates, and with a small number actually able to take advantage, the widespread demand of borrowed money will never be great enough to quickly drive up interest rates. The wealthy will be able to borrow for cheap, and likely rent out the property at high returns, as home ownership will decrease dramatically, and the American dream of home-ownership will turn to distant fantasy

Renters: You will soon be greater in numbers, as many American will revert back from ownership into the conservative life of renting. Without available funds, young professionals will no longer be afforded the opportunity to leap into early home ownership. Furthermore, some home-owners of the past will be sent back to the minor leagues, presented with new obstacles on the path back to the top. As I’v mentioned before, increased renting will drive up monthly rent prices (another reason why the investors mentioned above may want to take advantage of income property).

Property Managers: prepare to expand your business at lower prices to your clients. In the coming years, an increasing number of houses and various other units will be used for rental activity. Form strategy on how to accommodate the new renting generation, as they will likely seek the quality of a home, in rental form. These are long-term renters with a likely heightened demand for quality. Keep the complexion of the incoming tenants in mind, and adjust your business plans to accommodate for the surplus in renters.

Real Estate Agents: Depending on your niche in real estate, you will likely need to alter your approach to profitability. The purchasing power will now rest primarily in the hands of investors, and after the houses on the market now are unloaded, there will be no quick turnover on homes as we have grown accustom to over the past 40 years. Ownership will remain constant, so it is important to focus sales efforts in cities with substantial investment capital and great rental demand, as housing purchases will come from investment for the purpose of generating cash flow, requiring a renting population. Personally, I suggest cities containing large colleges/universities. Next, you will likely need to incorporate property management into your business model, as it will be the best way to secure consistent income in the long-term. However, many agents will also shift into property management, so be sure to provide a competitive advantage – use new technology available to create an efficient management company. Remember, the current state of the industry has little technological influence, and requires too much leg work to function properly.

But here is why you want to do everything you can to not drop your price. When you drop your price for any reason, it becomes the new price. No justification will sound reasonable to your customer when you raise the price back up to where it “should” be.Here are ways to avoid lowering our price;

Change the offer. You can offer a slightly different package of items, or a slightly different model for the same price. It isn’t that people have no money. It’s that they feel like they need a better deal for their money. Just give them what they would see as a better deal.

 

Add something for free. As long as the price stays the same, you cangive something away as a premium to make the offer look more attractive. Adding something for free makes it much harder for a customer to ask for a lower price.

Change the terms. If you add a longer payment term, it will lower the monthly payment (or account billing terms). It will feel to the consumer as though you are offering a better offer, even though you are really just giving better terms.

Add something for a better price on the add-on. Added on products can be offered for a reduced price instead of free. For example, if you sell men’s clothing, buy a suit and get the shoes for half price. Nobody is going to come back later for shoes and say that the price is twice what it used to be.

But three get one free. If they buy in greater quantity (at one time) they get a discount on the last one they buy, or get it for free. This offer can be discontinued later, without the price being compromised for one.

Offer free services or an extended warranty at little or no cost to the consumer. An extended warranty offered for free is a good inducement, and feels like a lower price. In fact if you give the price with the extended warranty built in, and then lower the price to your regular price without the extended warranty, you are giving the customer the feeling of a lower price with little out of your own pocket. Later, when you no longer include the warranty for free, your price will remain unchanged.

The big reason you do not want to lower your price; The customer will then know that you will lower the price. The price becomes flexible in the prospect’s mind. Once the customer sees that you will lower your price, they will negotiate everything they buy from you.

Do not artificially increase your price, just to take money off. These should be real offers that provide real value. That is selling.

It was quite cheesy and was essentially a commercial for various subscription services that promised to pick the point-spread winners of top games. By calling their 800 number you could supposedly hear one of those picks for free.

Curious about their sales techniques, and looking for some entertainment I called the number from my cell. I put the recording on speakerphone as we heard the screaming used-car-salesman-sounding guy pitch his service. We got a good laugh.

Then the next day, my cell rings, showing the call coming from an unidentified 800 number.

I answer, and immediately recognize the voice from the betting service. He jumps into an animated, yelling sales pitch. I am certain it is a recording. That is, until after two minutes or so he goes for the close. I remain silent. Then the voice says, “So what credit card do you want that on buddy?”

I said, “I don?t.”

Then, he/the recording pretty much ignored my response, and continued pitching the service. Then he closed again: “Let?s start making you money my friend. Which credit card?”

I continued, and so did he. Now, I’m wondering if it is a recording, or the guy himself, live. To test him, I threw out a nonsense response: “I’ll put it on my Costco card.”

Without missing a beat he replied, “I know that some people can see humor in losing but we take winning seriously and that?s why we will give you the point spread winners…” Finally, he wore me down and I just hung up, shaking my head that this kind of approach was still going on.

I thought that was the end of things. I was wrong. He called again Monday, same approach. I told the voice–or recording to take me off of his list. He continued pitching as if I had said nothing. I hung up.

He called again the next day. Same thing! I still couldn’t tell if it was a recording and a voice recognition program that was trained to give responses to certain replies. I was so annoyed I began using rather colorful language to describe him, his lineage, and something to do with his mother. He replied,

“No need to use profanity my friend. So when you get your picks from us each week…” Unbelievable.

I thought it would never end. Calls came the next two days. Finally, they stopped by the weekend, when I imagine they generated a fresh batch of leads.

So, any useable sales lessons here? Well, I did observe that the recording–or guy–was undaunted by resistance, essentially ignoring it and continuing. Granted, he was over the top with it, but too often legitimate salespeople are too quick to give up when faced with the slightest resistance. Instead, in many cases we can reply with, “I understand,” or “That’s OK,” and continue questioning.

i bought a car through a private sale will i need a bill of sale to register this in ny ? i have the titlte signed over to my name and my insurance card in the back of the title we wrote the amount of what i paid for the car will i need a bill of sale or can i still register it without a bill of sale ?
so the bill of sale wont be needed correct cause the amount paid for the car is on the back of the title.

What you need to register it is the title and proof of insurance. You will be transferring the title into your name. The price paid for the car is usually on the title the previous owner signed over to you. This is used for taxes.

In general, the homeowner/seller is the key to speeding up the short sale process.  By removing self-imposed roadblocks, you reduce delays so that you can close faster.

How do I write a bill of sale for a mobile home on a rented lot?

The wording is easy, your name goes in as buyer and then “your name as administrator of the estate of _______” as seller. You’re acting in 2 separate capacities. As far as what info. to include the first answerer was correct. Mobile Homes have VIN just like cars and that is a MUST to include. Attach a certified copy of your letters of administration to the bill of sale. It will probably be required anyway showing you have authority to act on behalf of the estate.

Check with a mobile home dealer and they may be nice enough to assist you.

**Also, I’ve been a paralegal in 3 states and this would be the procedure but not knowing what state you’re in I would double check this with an attorney.

EDIT: Always type a legal document, less room for misinterpretations and I don’t see a handwritten one getting accepted! Don’t feel like an idiot, you’re making the bill of sale to yourself but it’s coming from the estate so what they are asking you to do makes sense.

(Charges for mobile telecommunications service that are provided or deemed to be provided by a mobile telecommunications customer’s home service provider shall be sourced to the taxing jurisdiction where the mobile telecommunications customer’s place of primary use is located, regardless of where the mobile telecommunications service originates, terminates or passes through.

A “home service provider”; is a facilities-based carrier or reseller, with which the mobile telecommunications customer contracts for the provision of mobile telecommunications service.

Mobile telecommunications customer” means either:

(A) a person or entity that contracts with a home service provider for mobile telecommunications services; or (B) if the end user of mobile telecommunications services is not the contracting party, the end user of the mobile telecommunications service, but this clause (B) applies only for the purpose of determining the place of primary use. “Mobile telecommunications customer” does not include either (a) a reseller of mobile telecommunications service; or (b) a serving carrier under an arrangement to serve a mobile telecommunications customer outside the home service provider’s licensed service area.

[T]he street address representative of where a mobile telecommunications customer’s use of the mobile telecommunication service primarily occurs, and must be

(i) the residential street address or the primary business street address of the mobile telecommunications customer and

(ii) within the licensed service area of the home service provider.

(A) Any charge for a service or property billed by or for a mobile telecommunications customer’s home service provider shall be deemed to be provided by such mobile telecommunications customer’s home service provider.

(B) Charges for mobile telecommunications service that are provided or deemed to be provided by a mobile telecommunications customer’s home service provider shall be sourced to the taxing jurisdiction where the mobile telecommunications customer’s place of primary use is located, regardless of where the mobile telecommunications service originates, terminates or passes through.

Tax Law section 186-e.1(a) contains identical provisions covering the telecommunications excise tax.

A “home service provider” is a facilities-based carrier or reseller, with which the mobile telecommunications customer contracts for the provision of mobile telecommunications service.

Should a Health Practice Outsource Their Medical Billing

I have visited hundreds of Physician Offices and have seen a wide range of billing operations.  Physicians have a very difficult job to stay current on diseases as well as medical treatments.  The world of medical/insurance claims and practice management changes daily with new rules for rejecting claims as well as changes on how to bill (e.g. see article on “Billing Options For Flu Clinics”).  Insurance companies invest in ’scrubbers’ and software products that reject claims based on certain rules.  These rules change constantly.  There are vendors that create software for Insurance Companies with these claim edits.  I have met and seen these systems at the vendor display area of the American Health Insurance Plans (AHIP) annual conference.  Sales representatives for software vendors with this claim logic system sell to insurance company executives the amount of money their system can save an insurance plan.  Insurance executives are very aware that many billers for Physician Offices do not resubmit claims.  Insurance companies utilize these systems and some have probably denied what most would consider appropriate claims.  For example, the courts provided a judgment in 2010 against United Healthcare for using a software system that rejected many insurance claims that should not have been rejected.

 

Unfortunately, many owners of practices are losing thousands of dollars each year due to their billing system.  Worse, most are not aware that they are missing this revenue.  For example, a practice that generates $1,000,000 in total yearly revenue might feel that they are doing well.  Usually, I would ask a physician partner or practice administrator, “What is your collection rate of the contract insurance amount?”  Many practices are unaware what their collection rate of the contract amount.  Benchmarking organizations like the Medical Group Management Association (MGMA) consider collecting 95% of the contract amount for all claims to be ‘good’.  This would mean that if the practice brings in $1,000,000 per year in receivables that the practice is unable to collect $50,000.  This $50,000 is usually insurance claims and/or patient statements that poor billing systems/operations miss.  At Doctor Office Management, Inc, using the PhysicianXpress system, we have a system that benchmarks to 99% of the contract amount.  So far, we have been able to achieve this benchmark for our billing clients.

 

Many software systems used for Medical Billing are difficult for a physician partner to answer these simple questions.   Additionally, ‘drilling down’ or ’spot checking’ might not be possible for a physician partner to view specifics on a claim as needed.  I have been in physician offices for which the providers are very knowledgeable on Medical diseases, treatments and have invested much in their facilities and equipment but their billing systems that are based on technology from the 1980s or 1990s.  Since insurance rules change, in some cases, monthly, using a ‘dated’ system places the complete burden on the billing staff and practice managers.  Even if the billing staff and practice managers for a practice are top in their field, they would not have the time & resources to stay current with the insurance claim edits.

 

Speaking of billers and practice Management, there are many questions a physician partner needs to insure if they choose to perform billing and patient statements with their own staff.  Some of these questions include:  Do the billers and management have the depth of skills for today’s insurance climate?  Can all the billers explain the difference between a 99213, 99214 and 99215?  Are there formal SOPs in the practice which includes an audit system?  How much redundancy occurs in the operation?  Does the practice check the billers work and provide feedback?  If not, how much revenue is being lost that the practice owners are unaware of?  Does the practice management have the skills to interview and constantly check on the performance of the billers?  Is the practice able to bring in new talent that utilizes the latest or is there a system to improve the skills sets for the billers?  Does the practice establish benchmarks for ‘good’ performance?  What type of feedback loop does the billing team use to communicate with the other stakeholders and influencers of the revenue cycle (providers and front desk)?

 

There has been a dramatic shift in design of insurance policies in the last twenty years.  Billing and patient statements were very predictable when most of the insurances were 80/20.  Today, most insurances are PPOs/HMOs with <5% that pay the entire billed amount.  More and more patients have high deductible plans as well as plans that limit the number of well checks per year.  The revenue cycle is constantly changing.  Benchmarking is difficult to do with one physician office.  MGMA has a strong benchmarking history in practice management.  In some of the highly regarded revenue cycle courses they provide benchmarks.  One important benchmark is how many days of Accounts Receivable (AR) does the practice have outstanding.  If the practice bills on average $1000 (evaluate over 1 year of time) and the practice has $60,000 in AR then the AR days are 60.  MGMA sources show that 60 is the average for a practice and better the 40 is ‘good’.  Using the PhysicianXpress system, Doctor Office Management, Inc. benchmarks 30 AR days as ‘good’.  This is 25% higher benchmark than MGMA groups provide.

How do I secure a Title to a Vehicle when all the seller provided me was a Bill of Sale?

You may not be able to obtain a clear title for the vehicle. A bill of sale doesn’t mean the person you bought it from was the legal owner. I recommend contacting the DMV and ask for their help. How can I revoke a BILL OF SALE for a vehicle that was written as a DONATION?

I wrote the Bill of Sale as a donation, thinking that I could write it off as a tax deduction, then I found out that the donation has to be made to an organisation that has a taxpayer ID. If you gave him the title, you can’t do anything. Anyone with an ounce of sense knows the IRS needs proof that the vehicle was donated to a 501 (C) 3 charity. You don’t get that when just giving it to someone. The DMV wont and can’t do anything to help you.
