Given the housing market, we’re not surprised if you’ve just found out you’ve got an underwater mortgage. Right now 24% of all homeowners are in the same boat as you, with one in ten of them owing 25% more than their homes are worth!

So what are your options when you’re faced with an underwater mortgage? Let’s take a look:

Staying in the house and paying off the mortgage. This could be a sound business decision under a limited set of circumstances: if the value of your house is only, say, 5% to 10% less than what you owe on your mortgage, or if you’re close to having your mortgage paid off. And, of course, if you still have a job or business that lets you make the payments.

But don’t count on property values going up a substantial amount any time soon.

Right now, banks have a record number of foreclosed properties—1.1 million—and that number isn’t going to go down any time soon. It may well continue rising, and that means even more downward pressure on property values!

Loan modification. Don’t get your hopes up about this one—less than 3% of homeowners qualify for a modification on their underwater mortgages. And two of the available modifications will lead you to paying even more on that mortgage!

Deed in lieu. In this case, you hand the keys to the bank. You move out immediately. Then the bank sells your house for pennies on the dollar and comes after you for the rest of the mortgage. This isn’t an option—it’s another trap!

Short sale. This is an option where you and your mortgage lender agree that the lender will accept being paid by a sale on your home that doesn’t actually fully pay off the mortgage—called a “short” payoff. At worst, negotiating for a short sale gives you time to live in your house rent-free. At best, you can walk away from your underwater mortgage without having to take such a big hit on your credit rating!

Foreclosure. Don’t be shocked—foreclosure is a legitimate option for dealing with your underwater mortgage! Think about it—do big businesses or banks themselves keep paying on an underwater mortgage when property values drop or when they’ve run into financial trouble? They do not. Go ahead and look it up.

And then be angry about how the financial services industry has sold everyone a bill of goods about how we should be playing by different rules than they play by when it comes to underwater mortgages!

Granted, Kristin and I aren’t saying that anyone should let their morals sink to the level of your average CEO. But on the other hand, what higher moral principle is there than looking out for and protecting your own family?

Now, there are side effects to foreclosure. Your credit will take a hit, and in some states, your lender may try to milk you for the difference between what it sells your house for and the full value of the mortgage. The big banks are just starting to get aggressive about this in the past few months.

When I type bill of sale in a search engine all I got was legal zoom or other places that want to charge, I know there are some free forms I can download and print. Where do I go for these? Thanks.

I sold an old motercycle on ebay and the buyer is coming to get it tommorrow and he wants me to write a bill of sale. How do I go about doing this?

simply write the name of the person who bought the motorcycle, with the amount sold and place for him to sign.

Selling or buying property or a vehicle can be confusing and stressful enough, without the added worry associated with not knowing your rights. Protect yourself with a professional Bill Of Sale.

As Realtors, we know that a lot of our clients don’t think that there’s any such thing as life after a short sale or a foreclosure. They assume that their credit will be trashed forever, that they’ll become social pariahs, that their foreheads will be forever branded with a great, big, red “L” for “Loser.”

OK, maybe not that last one. But you get the picture. Most of us have let ourselves be so brainwashed by the banks that we really believe that a short sale or a foreclosure makes us bad people who deserve to be punished!

Kristin and I can certainly relate to that feeling! But would it make you feel better to know that we’ve been through not just one, but multiple short sales orforeclosures in the past 3 years? That’s right—we believed the “experts,” too, and we did a lot of investing in real estate before the bubble burst. So, yes, we went through multiple foreclosures and short sales, which we initiated, to get ourselves out from under a mountain of bad paper.

That’s right. We short sold or foreclosed on all of our personal properties.  And what are our lives like after foreclosure?

We still live in our own home; however, now we’re renting it for a fraction of our monthly mortgage payment from the cash investor we sold it to in a short sale.

Our credit did take a hit, but we know how to recover from that quickly (and we can show you, too!). In the meantime, it’s really not hurting us to pay cash more often and to live well within our means—which we weren’t doing when we thought we were high-flying real-estate tycoons!

We still have our family and friends. No one who matters thinks of us as anything but savvy business people who foreclosed or short sold because we had to save ourselves. And, better yet, our immediate family is more rock-solid than ever!

No sign of that “L” shaped branding iron. We promise.

Of course, you need to be proactive before a foreclosure or a short sale, so you can make the best life afterwards.

First, make sure you keep paying all of your other bills on time. This will make you seem like less of a credit risk even with a foreclosure on your record. And really, consider the millions of other foreclosures taking place during this time period. Does anyone honestly think that the banks will be able to afford to turn us all away as the economy recovers?

If you’re going to need a new car in the next 5–7 years, buy it before your first unpaid mortgage payment if you can. This will save you hundreds, or even thousands, of dollars of interest that you would probably be socked with after your foreclosure.

As for the rest of the money you’ll be saving when you’re not making house payments? Save it up! Don’t leave your house before you have to—live there for free while you’re making plans for your next move. That’s money you’ll be able to invest in your future!

So you see, you can have a good, happy, stress free and financially sound life after a foreclosure or a short sale. And the best thing is that giving up your house is a good lesson to us that, maybe, we really don’t need all of that stuff and all of that house that we were so attached to. If we learn that, we really come out ahead!

Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. But the financial adviser is asking me for a Bill of Sale. To me the bill of sale (especially signed) would be fraudulent because it would not actually be sold until the transaction of money and pink-slip between my bro-in-law and me.

Am I over thinking this?

It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

On the website of one major foreclosure listings provider, the prices of bank REO homes available for sale range from $734,555 to $2,198,000. One four-bedroom five-bath 3,867-square-foot home is listed at $920,020 while a three-bedroom two-bath 1,470-square-foot house is listed at a higher price of $1 million.

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. No, I don’t watch court tv. I started to a couple of times, but fell asleep! Maybe I should though…

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

Lets face it. Fraudulent internet purchases is rampant, worse for non-tangible items and in absolute chaos for mmorpg virtual item and account sales. To assume that there is not an abundance of nefarious individuals hacking paypal accounts and roaming the internet looking for their prey would be a catastrophic mistake.

Yes, I have fallen prey to these hungry villains in the past and they have gouged me deeply with their razor sharp daggers. I have learned allot over the past 8+ years. My experiences have enabled me to construct a sound prevention plan. Its implementation has brought my wife and I astonishing results as sellers of Ultima Online gold and Resources and Eve Online ISK on ebay. PayPal is great. I use PayPal exclusively as my payment gateway. They are safe, secure and cheap to use as opposed to using a commercial bank account account to accept credit cards. Sellers for the most part can feel safe because of Paypals Seller Protection policy. The problem here is that we as virtual / non-tangible item sellers is that we are NOT covered by this protection because we are not shipping an item and cannot provide proof of shipping. Security and fraud prevention is 100% our responsibility. There is no online payment gateway which offers protection for non-tangible items. Provide confirmed shipping/credit card address

Although we are not actually shipping an item this is very important. It helps us on several fronts including letting us know… that the buyer knows… their credit card billing address. We cannot view a buyers credit card info on paypal and it is the only way we have of knowing.

Call buyer. Require Phone number, Non cellular land line if possible.

ALWAYS, ALWAYS call a first time buyer no matter how small the purchase. This simple phone call is the single most important step in fraud prevention. It alone will wipe out more than 80% of the fraud.

Address and Telephone number match. In many cases we are able acquire an address from a telephone number by performing a reverse lookup on the buyers phone number using bigfoot.com . Keep in mind that bigfoot’s data is not always accurate and the address may not match but it will get you in the proximity. This simply means that we need to take additional steps for the confirmation. The phone type is not always accurate either, if you feel uneasy about the transaction and want to be sure of the phone type then I recommend using maxmind.com, it is a paid service but worth every penny. Maxmind will also provide more detail pointing out the anonymous types such as pay phones and store purchased pre-paid cell phones.

If it is a land line and that address also matches the paypal confirmed shipping address then we are looking good. Simply make the phone call to make sure that the phones owner is really making a purchase. The phone call is also used to insure that a child is not attempting the purchase.You would be surprised with the number of payment reversals we have had as a result of children hijacking their parents paypal account or Credit card. Cell phones may be acceptable depending on the situation and other provided information. We simply are not able to get enough info on cell phones to concrete any deal.

GEO IP lookup. Website owners should capture a buyers IP address and perform a geographical lookup on the IP address. Again I recommend using maxmind to do this. I have tried using many other lookup web sites and have found maxmind to be the most accurate. AOL IP’s will not resolve properly because of their funky proxy system, otherwise maxmind will see through most other proxy systems or at least inform you of it. In this case one may want to be stricter on some of the other prevention measures. In any case if it resolves to a country other than the buyers country you should always refuse the order.

I typically only use this if I am still a little concerned about the purchase and the buyer has provided a cell phone number or the GEO IP LookUp was unsuccessful. Simply ask the buyer for their Internet service provider email address, send them an email and ask them to reply to it. Do not rely on hotmail, gmail, yahoo etc email addresses. Anyone can get those and they serve no purpose in regards to security.

In Texas, can you get a motorcycle you bought insured and inspected with only a bill of sale?

In other words, you have purchased a bike with no title. (I know the dangers of this already, thanks). But the seller gave you a bill of sale. Can you get it insured and inspected with only a bill of sale? How about registration?

You will need to go to DMV with the bill of sale. They can run a check on the bike and make sure of ownership. The seller may have to sign some forms but you should be able to get a title. Baring any problems with ownership and signatures, once the bike is in your name you can get it insured.

How to Begin a Winning Sales Letter

As American’s, and leaders in auto bill of sale, vehicle bill of sale, and property bill of sale forms, we know the importance of protection, especially personal protection.

In a recent Sunday issue of the New York Times, I came upon a 12-page insert promoting The Economist, a wonderful magazine that I’ve enjoyed for years. The production values of The Economist’s slick piece, designed to attract new subscribers, were absolutely first rate. The insert featured four-color printing, attractive art direction, a terrific “free trial” offer, etc.

There was one big problem, however. The two-page pitch letter, that was part of the mailer, sounded as if it was written by a non-native speaker. I just don’t get it. I wish someone could explain to me how a letter like this ever sees the light of day. Here . . . read the first two paragraphs of the letter yourself and see what YOU think of it:

“Dear Colleague:

There is no doubt that The Economist is enjoying an unprecedented dynamism in the latter half of its second century. Its unlikely name is bandied about and bragged upon in the highest places. Our essentiality has arrived. The interdependency of the world has been brought home all too clearly. The case for global intelligence has been  made. The Economist provides it in a unique and refreshing  way. Thus, our reputation.”

See what I mean? Instead of trying to appear so darn erudite, (and winding up sounding muddled), the copywriter of the letter should have stuck to basics. How should the copywriter have begun the letter? More importantly, how should YOU begin YOUR next sales letter? My advice to all non-professional copywriters is to come out swinging. Make your offer right up front!

Let me show you how much better the Economist letter would  have been had the copywriter skipped the fluff and led with the offer:

“Dear Friend:

Bill Gates, the Chairman of Microsoft, recently said, “The magazine I spend most of my days reading is The Economist.” Larry Ellison, CEO of Oracle, said, “I used to think. Now  I just read The Economist.”

If you want to see for yourself why The Economist has such incredibly enthusiastic (and successful) readers, here’s a no-risk FREE offer not to be missed . . . You get the picture. When you’re starting a letter, set things up quickly, then plunge right into the offer. You won’t go too far wrong. (NOTE: Those terrific Gates and Ellison quotes are real by the way!)

When buying a grade horse, should I get a bill of sale or is a personal check enough?

The other grade horses I’ve bought through the years were from friends and people I knew so we didn’t bother with it.
This weekend I am going to look at some and I called the guy and they are at his aunt’s house, he says some are his and some are his brother’s, he doesn’t know which ones his brother wants to keep, I have to be there when he says, doesn’t sound to eager to sell anything even though he had an ad out. Something just doesn’t feel right.
If you think I need a bill of sale, what should it all include?

Absolutely get a bill of sale! And another safe thing to do is to write the information on the memo line of your check too. On the bill of sale just have the age, color, sex and any markings, brands and scars, if any. Make sure he signs the bill of sale also. It does sound fishy though. Is there anyway you can request that his brother be there to? That way this guy doesn’t sell a horse he isn’t suppose to. Another thing, make sure he puts the address that your purchased them at. And proof of his identification…sounds bad but that way you have something to compare his signature to and if some asked me for proof of identification on selling the horse…I would provide it. Also, save the ad that brought these horses to your attention. That way if something bad does happen…you will be able to show the judge that ad.
I helped a friend out by buying a horse from her and when I wrote her the check…I put the information there too even though she gave me the bill of sale. Better safe than sorry…=)

With my sons 21th birthday fast approaching he was desperate to have his own house but he couldn’t afford the costly bills that come with having a house of his own. My husband and I had looked into building a small house for him in our garden but we just couldn’t get the planning permission. Our neighbour had a son a few years older than ours and had come across the same problem (its so uncool to live with mum and dad still!). They suggested to us that we put a static caravan in our garden for him to live in.

Searching the internet we found many sites selling lovely static caravans that would be perfect for him. After long discussions we found the perfect caravan with 2 bedrooms and double glazing and central heating, it was a lovely modern caravan that suited him down to the ground. This way he could still have his own place but was close enough if he needed anything. When we went to view the caravan the staff couldn’t have been more helpful, we chose the caravan we wanted and we also had a member of the company come to view our garden so we could arrange the best place for the static caravan to be placed and the easiest access for the lorry to drop the caravan off.

We then planned the day before my son’s birthday to surprise him. We had the site levelled and the electric and water connected; this was all done within two days, alot less than if we had built a house for him! On the morning of his birthday he was so excited to see the caravan in our garden he loved the fact we had brought the static caravan for him, it was his own place to live but he could still afford to go out with his friends. He thought this was a perfect idea and so did we, we would recommend to anyone in a similar situation to think about looking on the internet there are many static caravan companies online that you can go on and find your perfect caravan just like we did.

What to do if Bill of Sale is missing in NC in order to register vehicle?

I just moved back to North Carolina and went to register car. I had the title of the car but misplaced the bill of sale. The dealership was taken over a few years ago and I am still hunting down records. The car was paid off in 2002. Can I sell it(car) to my spouse for a dollar?

here is the thing you do not need the bill of sale. contact the finance company that financed the car originaly and request a duplicate lien release form from them then go to the N.C. dmv and get a MVR 4 form and complete it use the section that says reassignment of title by registered owner to sign the vehicle over to your spouse. North Carolina no longer calculates the amount of road tax you will pay based on the sale price of the vehicle they got wise to that old trick but if you sign your MVR 1 form stating you are giving the vehicle to a spouse or child then you will not be charged highway use tax you will only be charged the 35.00 tittle transfer fee the 5.00 notary fee and the 28.00 license plate fee. and you will be able to get tags no problem

you need to take the bill of sale and the title to the DMV or in some cities you have to go to the clerk and recorder, You may or may not again depending on where you live have to have insurance first. I have a motorcycle registered in montana and I have never ridden it and therefore it is not insured but I still got the registration and plates. you might try calling them before actually making the trip.

Is it ok to write out a bill of sale for my 25 year old mobile home?

My late uncle died without a will, and his father left it up to my late uncle’s brother to take care of everything. My late uncle’s brother told me i could take control of the full size mobile home. The mobile home is over 25 years old with no title in the state of Alabama, and i am wondering if would be legal to write out a bill of sale to sell the mobile home to someone.

In most states if the mobile home is in a leased space mobile home park, or its just the mobile home that is being sold then you write out a bill of sale.

If the mobile home is on land and the land is part of the deal then its a real estate transaction.

GENERAL INFORMATION:

Manufactured homes are governed according to the Code of Alabama 1975, Title 40 Chapter 12, Section 255. Manufactured homes must be registered within 30 days of purchase. Failure to comply with the State law could result in the issuance of a penalty of $10 as well as citation fee of $15. Homeowners who fail to obtain and/or correctly display a manufactured home decal, if found guilty in court, can be fined up to $500.00, and/or sentenced up to six (6) months in the county jail under Section 40-12-255.

Manufactured Homes must be registered in the License Department or the Tax Assessor’s office. Decals will be issued in the appropriate office. The License Department decal is a rectangle with the outline of the state of Alabama; the Assessor/Collector decal will be square with Ad Valorem Taxes printed on the decal.

REGISTER WITH TAX ASSESSOR IF:

The Tax Assessor/Collector will register the home if the land and home are in the exact same names. If the home and land were purchased as a package, there will be no sales tax collected; however, if a title fee is due, this must be collected. If the land and home are exact and the person lives in it, you will register with the Assessor (homestead can be claimed). If the land and home are exact and a family person lives in the home, you will register with the Assessor at a higher tax rate.

REGISTER WITH LICENSE DEPARTMENT IF:

The License Department will register the home if only the home is owned and not the land. Also, if the home is rented, it must be registered in the License Department. You must also pay the appropriate sales tax as well as a title fee if purchased from an individual or an out-of-state dealer and home is a 1990 or newer.

BILL OF SALE:

A Bill of Sale is required on all transfers of manufactured homes sold by individuals. If purchased from an Alabama dealer, we must see the bill of sale to verify sales tax has been collected. If purchased from an out of state dealer, a copy of the bill of sale must be made and the appropriate sales tax collected.

Sales tax for Manufactured homes is 2%.

Sales Tax will be collected on the amount reported on the Bill of Sale. No Bill of Sale is to be accepted for $1.

TITLES:

Any Manufactured Home 1990 or newer must have a title.

If purchased from an Alabama dealer, the title application should be provided by the dealer.

If purchased from an individual, the title must be signed and the License Department will apply for the Title. Be sure to check lienholder information.

DELINQUENT/CITATION/PENALTY:

Once a year, the Tax Assessor and License Department inspect all manufactured homes in Madison County. Each homeowner must have their decal displayed. If not, a citation is issued and mailed to each homeowner.

Here are fourteen ways to help you make the transition from speaking to selling…

1.     Make your intentions clear.

Ever heard of the term “leaving money on the table!”?  Well, a lot of speakers do that. That’s a problem. A HUGE problem, mainly because you have bills to pay, right? Unfortunately, some speakers actually get so caught up in delivering their message they forget to sell their products at all. The secret to effective public speaking is to always make sure you multi-task when planning your presentation. Remember: you are running a business.  Always create events, or get hired by an event planner  where you can both give a great speech (and get the fee you want) PLUS sell lots of products in the back of the room!

2. Put your ego on standby.

Yes, I love the sound of applause, but believe it or not, getting a standing ovation can sometimes interfere with your selling process. Set your ego aside while speaking so that you can sell. Doing so will encourage the audience to appreciate you with their money after the speech.

3. Don’t be embarrassed.

Never be embarrassed about selling your  products. If they’re excellent and deliver value to your audience, then you are doing  a service by selling to your adoring fans and spreading your name, knowledge, and ideas. Oh, here’s something to think about: if you’re giving a FREE speech then you absolutely sell products from the back of the room. And the person who hired you will have no problem in allowing that.

4. Create credibility.

Build credibility by sending good pre-program materials, providing a great written introduction, and knowing what you’re talking about. Trading mentions with other speakers can be helpful, too.

5. Create strong opinions.

Being super likeable and being a jerk both create sales. Either get to know your audience or be a total jerk, and the strong opinions you will create will help generate more sales.

6. Speak to your audience quickly.

You need to move slowly enough that people understand your basic ideas but quickly enough that they need to review them again later.

7. Learn and know your audience.

Your speech should be just a level above your audience so they have to think hard to follow you. This will make them want to buy your materials to grasp your ideas further.

8. Give the audience need.

Use phrases throughout your speech that make your audience feel that they need your products. Do this well before closing your speech, and you’ll get more and better sales.

9. Weave in testimonials and success stories.

Audience members want to know they’re making the right decision when they are buying from you. A good technique to take away buyer’s resistance  and to prove the value of your products  is to project testimonials on a screen or read them aloud for great effect.

10. Weave your products into a speech or session.

Another effective technique to use when wanting to sell from the platform is to use your projects, or mention them during your presentation. Doing this gets your audience wanting them before they even know they’re for sale.  In addition, you can also sell items if you aren’t allowed to technically sell them because audience members can come asking about them.

11. Use a raffle or drawing.

Another Guerilla Speaking technique is to hold a raffle from the platform. While you are doing it, you’re actually describing and soft selling your product while announcing the winner. You can also build online databases this way if you get permission to email your audience members.

12. Don’t make too many offers.

Less is more when it comes so selling from the platform.  But of course there are exceptions.  The more you tell… the more you sell. Now, if you have a short speech — only deliver one offer.  But in a longer presentation, and if the product has a higher price point, then I usually make one offer and one upsell.

13. Package your products.

Here’s a cool marketing secret. Bundle smaller products together as your speeches bring bigger ticket prices. That way, you know your audience has the money to pay for more and bigger products. Selling in systems or kits can help, and getting your products on the market makes you more likely to make money from consulting, mentoring, and the like.

14. Put a guarantee on it.

Make dealing with you risk and stress free. People are more likely to buy your products if they know they have a money back guarantee. Some give a 30 day guarantee. Others give a 90 day guarantee. The longer you go out with your guarantee the more sales you will have and the more product(s) you will sell.

The above tips are proven strategies that have worked for me and other speakers. I know ’selling’ can be a dirty word to some people. But in one way or another we are all in sales, aren’t we? When you persuade someone to see your side of an argument, guess what? You are selling. When you persuade someone to marry you, that’s the ultimate selling presentation. The world goes round and round with selling… and you can do it in a way that works with your values!

I bought a jeep in the spring and was trailering it to go wheeling, but now i sold my car and my truck is a gas hog so i was looking to get my jeep on the road. when i bought it, it was said to be a salvaged vehicle and the title was lost at the salvage yard, so i got a bill of sale. if anyone knows how to possibly get a title form a bill of sale or if it is even possible. i dont know if its any different other places but im in pennsylvania.

Tomorrow I’m meeting with somebody to purchase their car for my car, and an additional $3,800 on my part. We are planning to write bill of sale forms until my title comes in the mail this Friday. I was wondering if there is any Bill of Sale form out there that includes partial trade, or if there is a way to incorporate it with a regular Bill of Sale forms.

Open to any advice, comments, or opinions.

No there is not a specialized form to cover the case you describe above. I would use two bills of sale. One covering your sale of your vehicle to the other party (if I were that other party I would insist on it) and a second bill of sale from the other party to you, listing as consideration (purchase price) your car with the full legal description from the pink slip and also listing the additional $3,800 in cash.

I’m curious can I sue him for not giving me a bill of sale since I have to do taxes and cant because no bill of sale. I paid 125,000.00 and he is still working under my name and I have proof I paid him.

If he didn’t sign anything then you didn’t buy anything. Since you paid, a judge will provide equitable relief (assuming you can prove you paid and that it was for the company) in the form of compelling the former owner to give you the bill of sale. Get a lawyer.

How do I secure a Title to a Vehicle when all the seller provided me was a Bill of Sale?

I purchased a car at a private sale from an individual who had previously bought the vehicle without a title. He had garaged the vehicle and never tried to get a title. All I have is a Bill of Sale. I understand that there is a process called The “Notary Certificate of Dishonor” that would help me secure a title to the vehicle. Anyone with information on how this process works that i might secure a title would be appreciated.

You may not be able to obtain a clear title for the vehicle. A bill of sale doesn’t mean the person you bought it from was the legal owner. I recommend contacting the DMV and ask for their help. You should also ask the seller why he did not have a title for it. There may well be a lien against it. Good luck.

My grandma sold me a truck in January but I never registered it due to all the DMV fees and what not. I have the bill of sale from then and the transfer of title that she signed, but now I need to sell it. Can I due it with just the two?

In California you just need the signed title and smog cerificate.
The title acts as the bill of sale. So throw out your bill of sale.
If you filled out the back as the buyer already, then get a REG 256 Statement of facts and say “buyer never took possession of vehicle and filled out title in error” And sell the car with just your grandma as the seller. Now you need an additional paper for the new buyer to fill out. REG 101 Statment of Erasure or Error. Have the new buyer fill this out AND give him the title with grandmas signature.

It’s sellers responsibility to get car smogged.
Don’t let grandma forget to sign a Release of Liability and turn into the DMV or AAA within 5 days of sale.

If you are the one of the approximately 20% of American homeowners that is upside down on their mortgage, meaning you owe more than your property is worth, a new program known as Principal Reduction may be just what you’ve been waiting for.

A Principal Reduction, unlike a loan modification which is only a temporary reduction in the interest rate a homeowner pays, is a permanent reduction in the outstanding loan balance owed. This program is offering upside down homeowners a way to stay in their homes and erase the negative equity the American nightmare of the past few years has cast them into. The program is funded by a $5 Billion dollar hedge-fund that is essentially involved in a large scale Note Purchase program. The hedge-fund buys large groups of Notes, all of which are upside down homeowners, on what is known as the secondary market. The hedge-fund gathers Notes from clients across the country and leverages the portfolio to buy the entire group of Notes at a substantial discount to current market value. Due to the fact that an upside homeowner is likely to walk away from their property in the near future, the banks are often accepting these offers in order to rid their books of these potentially toxic assets. The hedge-fund then adjusts two items on the existing Note. The outstanding principal balance is reduced to 95% of current market value and the interest rate is changed based on the homeowners credit quality. In the end, the homeowner receives a permanent reduction in their principal balance, often to the tune of a few hundred thousand dollars, and the hedge-fund makes a profit on the difference between the purchase price and the new 95% of market value principal balance. A true win-win scenario for everyone. Even the banks walk away ahead as they have now rid themselves of future foreclosure risk and have the influx of capital to put to work in their business, which is lending. Homeowners who are disenchanted by the loan modification process and restrictions placed on them and want to stay in their homes, rather than just walk away from their property, or be forced into a short sale now have a viable option which appears to be far superior to either.

In California you just need the signed title and smog cerificate.
The title acts as the bill of sale. So throw out your bill of sale.
If you filled out the back as the buyer already, then get a REG 256 Statement of facts and say “buyer never took possession of vehicle and filled out title in error” And sell the car with just your grandma as the seller. Now you need an additional paper for the new buyer to fill out. REG 101 Statment of Erasure or Error. Have the new buyer fill this out AND give him the title with grandmas signature.

It’s sellers responsibility to get car smogged.
Don’t let grandma forget to sign a Release of Liability and turn into the DMV or AAA within 5 days of sale.

Is it ok to write out a bill of sale for my 25 year old mobile home?

My late uncle died without a will, and his father left it up to my late uncle’s brother to take care of everything. My late uncle’s brother told me i could take control of the full size mobile home. The mobile home is over 25 years old with no title in the state of Alabama, and i am wondering if would be legal to write out a bill of sale to sell the mobile home to someone.

In most states if the mobile home is in a leased space mobile home park, or its just the mobile home that is being sold then you write out a bill of sale.

If the mobile home is on land and the land is part of the deal then its a real estate transaction.

GENERAL INFORMATION:

Manufactured homes are governed according to the Code of Alabama 1975, Title 40 Chapter 12, Section 255. Manufactured homes must be registered within 30 days of purchase. Failure to comply with the State law could result in the issuance of a penalty of $10 as well as citation fee of $15. Homeowners who fail to obtain and/or correctly display a manufactured home decal, if found guilty in court, can be fined up to $500.00, and/or sentenced up to six (6) months in the county jail under Section 40-12-255.

Manufactured Homes must be registered in the License Department or the Tax Assessor’s office. Decals will be issued in the appropriate office. The License Department decal is a rectangle with the outline of the state of Alabama; the Assessor/Collector decal will be square with Ad Valorem Taxes printed on the decal.

REGISTER WITH TAX ASSESSOR IF:

The Tax Assessor/Collector will register the home if the land and home are in the exact same names. If the home and land were purchased as a package, there will be no sales tax collected; however, if a title fee is due, this must be collected. If the land and home are exact and the person lives in it, you will register with the Assessor (homestead can be claimed). If the land and home are exact and a family person lives in the home, you will register with the Assessor at a higher tax rate.

REGISTER WITH LICENSE DEPARTMENT IF:

The License Department will register the home if only the home is owned and not the land. Also, if the home is rented, it must be registered in the License Department. BILL OF SALE:

A Bill of Sale is required on all transfers of manufactured homes sold by individuals. If purchased from an Alabama dealer, we must see the bill of sale to verify sales tax has been collected. If purchased from an out of state dealer, a copy of the bill of sale must be made and the appropriate sales tax collected.

Sales tax for Manufactured homes is 2%.

Sales Tax will be collected on the amount reported on the Bill of Sale. No Bill of Sale is to be accepted for $1.

TITLES:

Any Manufactured Home 1990 or newer must have a title.

If purchased from an Alabama dealer, the title application should be provided by the dealer.

If purchased from an individual, the title must be signed and the License Department will apply for the Title. Be sure to check lienholder information.

DELINQUENT/CITATION/PENALTY:

Once a year, the Tax Assessor and License Department inspect all manufactured homes in Madison County. Each homeowner must have their decal displayed. If not, a citation is issued and mailed to each homeowner.

How can I revoke a BILL OF SALE for a vehicle that was written as a DONATION?

I wrote the Bill of Sale as a donation, thinking that I could write it off as a tax deduction, then I found out that the donation has to be made to an organisation that has a taxpayer ID. Now the guy doesn’t want to pay for it. Is there a legal way I can retake possession of the vehicle? Can I take the plates off the vehicle and visit the DMV and get them to help me?

If you gave him the title, you can’t do anything. Anyone with an ounce of sense knows the IRS needs proof that the vehicle was donated to a 501 (C) 3 charity. You don’t get that when just giving it to someone. The DMV wont and can’t do anything to help you.

Having A Quick Home Sale

For a quick sale, you need to make your home look better than the competition. When I look through pictures of real estate online, I see so many pictures of messy rooms. People haven’t taken the time to even tidy up a little before they or their agent take the photos that will be any buyers first impression. So often in these photos, the tv’s are on and there are cans of pop on the coffee table. This looks so ugly! So I think the easiest way to make your home look better than most is to simply clean it up.

First off, tidy the surfaces. Clearing away dishes and your daily clutter is the bare minimum you can do to at least let a buyer see the house that sits underneath it all. Then make the beds. If you want to do more, and really you should, take a hard look around. Are your surfaces covered in decorations? If so, are these here because they enhance the room, or because they have sentimental value? If the answer is the latter, get rid of it, at least for the time being. Start packing, even if you don’t know where you are going to move. You will be glad you did for at least a couple of reasons. First, potential buyers won’t be distracted by your clutter, and second, you’ll be that much further along when it does come time to move.

Look around the home again. Is it crowded? If you have more furniture than you absolutely need, or than fits comfortably in the room, consider packing it up also. The same goes for projects you’ve been working on. If you aren’t actively working on them, put them away until after the move. Renting storage space is a good idea once a critical eye shows you just how much you can remove from your home while it is for sale.

But all this doesn’t mean emptying your home to achieve that un-lived-in feel. On the contrary, you want your home to be cozy. There is a balance between cluttered and cozy, and you must find it. Once you’ve done a thorough clean-up, which obviously includes making bathrooms and kitchens shine (these are key selling features and should not be overlooked), make the beds and toss the pillows neatly on the couch. Position your remaining decorations in a way that truly accents the room, such as placing two dramatic candle sticks on the mantel, or even a teddy bear on a tidy bed.

To help make the rooms feel live-able and warm, turn on the lights. So often, these real estate pictures I mentioned at the start of this article have been taken at night. Dark windows or even closed blinds make a home look dreary to me right away. Have your agent come by during the day to take pictures of your home, and be sure to take advantage of both natural and artificial light to make your home appear bright and desirable.

When it’s time for your home to be shown, play some quiet, mellow music during showings, but by all means, leave the tv off. Consider creating some pleasant smells, as these too impact a buyer’s first impression.

By making your home stand out, you increase your chances of a quick sale, at the rate you are asking. So do yourself a favor and put in that extra effort. You’ll be glad you did.

Why do I need to provide a bill of sale to buyers financial advisor before receipt of payment?

Okay. I’m selling my vehicle to my bro-in-law. He is not allowed to get a large amount of money without the “go-ahead” from his financial adviser. But the financial adviser is asking me for a Bill of Sale. To me the bill of sale (especially signed) would be fraudulent because it would not actually be sold until the transaction of money and pink-slip between my bro-in-law and me.

It is safer to issue a Contract-to-Sell (CTS) agreement stating therein all relevant details about the sale including the amount due for payment, the dates when it becomes due, and the seller’s right to rescind the contract in case of buyer’s default. It sounds like you agreed to sell and your brother-in-law agreed to buy but you have not been paid yet. So, a CTS is more appropriate at this stage until the amount due is paid in full. You can state in the CTS that upon full payment, the seller (you) will issue to the buyer a Bill of Sale… for him to proceed with the transfer of ownership.

As far as his financial advisor is concerned, a CTS should be sufficient proof of the agreement that his client entered into.

However, if it\’s a 20% to 25% commission with a continuing income component, have a closer look prior to rejecting it. There are two key reasons to think about this type of commission plan:

1.) By the end of the year, you will get a great deal more cash with the same sales volume.

2.) When you have a bad month, it is not the end of the world. Your residual commission still gets paid out.

Remember, the commission-only sales jobs market is not a survival strategy for jobless sales agents. The business is still trying to sell and still depends on experienced sales staff to get the job done.

If you have always aspired to be a sales person, but have no experience, or you are not a really productive salesman, do yourself as well as the company a favor. Do not apply for the sales rep job. This is a strategy for the skilled sales person only.

It can be a very challenging and depressing process for an unemployed sales professional to find a position doing the work they love. Sorry to say, many overlook possibilities because they reject commission-only sales jobs out of hand, without digging into the whole comp plan.

Commission-only sales jobs , with a recurring commission component offers the successful salesperson the opportunity to ramp up income quickly, while enjoying income protection on a slow month. There are no income caps and no holdbacks. The days of \”one sale, one commission\” are over with this plan. Now, go after the sales jobs that provide the income you need.

You would be asked for proof of identity and would have to sign again – either on the bill of sale or a separate piece of paper to verify the signature. You may be able to get a notary to simply notarize both signatures, however that’s a good way to lose your notary privileges.

Although, not all security breaches succeeds, and most merchants do not acknowledge these incidents unless there’s a significant probability that a major fraud has already been identified or about to take place. Furthermore, credit card issuers usually do not close a customer’s account unless fraud has taken place.

Restaurateurs may have a difficult time with credit card security rules, since its regulations can be very hard for small merchants. The National Restaurant Association trade group says that it hears from restaurant owners who thought they complied with rules, but found out their systems were not functioning properly and were penalized.

Over $100,000, in some cases, is the fine for restaurants that violated credit card industry rules by keeping credit card information. Merchants across all categories $4.6 million for security violations were fined by Visa in 2006, an increase from the $3.4 million in fines the previous year.

After recently conducting special security briefings with several hundred restaurants, although they declined to provide a breakdown of merchant types, Visa believes a merchant group needs additional attention.

During the same time, the companies that process credit cards have also turned the heat on restaurants. Credit card companiesthreatened those who do not follow security regulations that they will end their services.

Most restaurants uses software combining such features as tabulating bills, delivering orders to the kitchen and tracking reservations, credit card companies are worried because they cannot force software developers to follow their security rules, so the pressure it passed on to restaurants. In Visa’s web site, they maintain a list of software programs that meet its requirements.

But software makers that even with the best software, restaurants can still be in a lot of trouble if they lack ample password protection or firewalls. Software companies say it is not up to them to let restaurateurs know what they must do to be in compliance with credit card rules.

I just bought a motorcycle from Texas and I live in Louisiana. I obtained a signed and notarized title, but forgot to get a bill of sale when I left. I bought a company and the owner never signed over the bill of sale?

I’m curious can I sue him for not giving me a bill of sale since I have to do taxes and cant because no bill of sale. I paid 125,000.00 and he is still working under my name and I have proof I paid him.

If he didn’t sign anything then you didn’t buy anything. Since you paid, a judge will provide equitable relief (assuming you can prove you paid and that it was for the company) in the form of compelling the former owner to give you the bill of sale. Get a lawyer.

So I found out I need a bill of sale to get plates for a car that I bought from a private seller. Only problem is I don’t have his contact information and he lives in another state. I have his address that is listed on the title but that’s not his current address, so my step dad was going to do a bill of sale for me since he used to work in the car business. Would a hand written bill of sale matter, or should it be done on the computer?
